【摘要】：在日本由經(jīng)濟(jì)大國轉(zhuǎn)型為政治、軍事強(qiáng)國的道路上,軍事法起到了保駕護(hù)航的重要作用。為了確保軍事法的有效運(yùn)行,日本建立起多元立體的軍事法制監(jiān)督網(wǎng)絡(luò)。國會、各級政府、最高法院以及社會公眾等主體根據(jù)法律賦予的不同監(jiān)督權(quán)力(利),對軍事法的制定和實(shí)施進(jìn)行各種監(jiān)察、控制和督導(dǎo)活動,為實(shí)現(xiàn)對軍事權(quán)合法運(yùn)行的控制功能而形成一個相互聯(lián)系、相互作用的有機(jī)整體。通過探究日本軍事法制監(jiān)督的體系構(gòu)成,分析其權(quán)力架構(gòu)及運(yùn)行模式,對于促進(jìn)我軍整風(fēng)反腐的深入推進(jìn)和依法治軍建設(shè)順利進(jìn)行,具有重要的啟示和借鑒意義。
[Abstract]:Military law plays an important role in protecting Japan from an economic power to a political and military power. In order to ensure the effective operation of military law, Japan established a multi-dimensional military legal supervision network. The Congress, governments at all levels, the Supreme Court and the public at large carry out various supervision, control and supervision activities on the formulation and implementation of military laws in accordance with the different supervisory powers (benefits) conferred by the law. In order to realize the control function of the legitimate operation of military power, it forms an organic whole which is interrelated and interacted. By exploring the system structure of Japan's military legal supervision and analyzing its power structure and operation mode, it is of great significance to promote the further promotion of anti-corruption in the rectification movement of our army and the smooth construction of administering the army according to law.
