論馬克思主義法學(xué)中國化的特色及其實現(xiàn)方式

【摘要】：馬克思主義法學(xué)是在馬克思主義世界觀和方法論的指導(dǎo)下不斷豐富和發(fā)展起來的法學(xué)理論體系;它具有科學(xué)性、實踐性的理論品質(zhì)。馬克思主義法學(xué)中國化,就是運用馬克思主義法學(xué)的基本原理、立場、觀點和方法同中國革命與建設(shè)、特別是同當(dāng)代中國的民主與法治建設(shè)緊密結(jié)合,立足中國國情而形成中國特色社會主義法學(xué)理論體系的過程,是理論與實踐的結(jié)合,具有具體化、民族化、大眾化和創(chuàng)新性的特色。 馬克思主義法學(xué)在其中國化過程之中,以自己本學(xué)科的特點,以革命法制和社會建設(shè)法治為主要內(nèi)容,有力的促進(jìn)了社會主義革命的勝利和社會的建設(shè),形成了中國特色社會主義法學(xué)。馬克思主義法學(xué)中國化的實現(xiàn)是必然的,因為具備了發(fā)展的歷史條件。 實現(xiàn)馬克思主義法學(xué)中國化,一方面要對社會實際進(jìn)行調(diào)查研究,掌握馬克思主義法學(xué)理論與中國社會實際問題的結(jié)合情況,透析馬克思主義法學(xué)指導(dǎo)中國實踐的實際效果,通過實踐中運用、總結(jié),再實踐、再總結(jié)而發(fā)陳出新;另一方面要清除對馬克思主義法學(xué)的教條式理解、錯誤附加和任意解讀,對于不適合當(dāng)代中國實際的馬克思主義經(jīng)典作家針對某些特定情形的理論判斷予以舍棄,明確馬克思主義法學(xué)的革命法制理論和社會建設(shè)法治理論適用情形的界限。 要堅持科學(xué)的態(tài)度應(yīng)對主導(dǎo)思想的邊緣化,看清和排除各種錯誤思想的干擾。堅決反對把馬克思主義法學(xué)魔化的思想。要以正確的思想路線糾正教條主義錯誤,樹立“解放思想、實事求是、與時俱進(jìn)”的思想路線為根本指導(dǎo)原則。以實踐做為產(chǎn)生、檢驗、發(fā)展法學(xué)理論的根本途徑。合理地借鑒與吸收世界各國法律文明的優(yōu)秀成果,以經(jīng)過淬煉的有益成分不斷充實法學(xué)理論。不斷增強中國特色社會主義法學(xué)的民族特色。更深入的挖掘歷代法律文明成果,去其糟粕、取其精華,對那些于今天的中國法治建設(shè)實際具有積極意義的成果加以合理利用。通過批判地繼承,不斷豐富中國特色社會主義法學(xué)的內(nèi)容。 加大傳播力度,實現(xiàn)科學(xué)理論的大眾化。法學(xué)理論的傳播要和宣傳法律等普法運動結(jié)合起來。把中國特色社會主義法學(xué)的內(nèi)容和要求通俗化、具體化、形象化,真正深入老百姓的生活,真正為廣大群眾所理解和掌握。培養(yǎng)和造就一支政治可靠、功底扎實、熟悉基層、善于運用群眾語言進(jìn)行理論闡釋、理論宣講和理論普及教育的人才隊伍,加強對各級政府機關(guān)工作人員進(jìn)行社會主義法治理念、精神的教育和普及。
[Abstract]:Marxist jurisprudence is a legal theory system which is enriched and developed under the guidance of Marxist world outlook and methodology, and it has scientific and practical theoretical quality. The Sinicization of Marxist jurisprudence is to use the basic principles, positions, views and methods of Marxist jurisprudence in close combination with the Chinese revolution and construction, especially with the construction of democracy and the rule of law in contemporary China. The process of forming the legal theory system of socialism with Chinese characteristics based on China's national conditions is the combination of theory and practice, with the characteristics of concretization, nationalization, popularization and innovation. In the process of Sinicization of Marxist jurisprudence, with the characteristics of its own discipline and the rule of law of revolution and social construction as the main content, Marxist law has been able to promote the victory of the socialist revolution and the construction of the society. Formed the socialist law with Chinese characteristics. The realization of Marxism law in China is inevitable, because it has the historical condition of development. In order to realize the Sinicization of Marxist jurisprudence, on the one hand, we should investigate and study the social reality, grasp the combination of Marxist jurisprudence theory and the practical problems of Chinese society, and analyze the practical effect of Marxist jurisprudence guiding China's practice. Through the application, summary, practice, and then summing up of the practice, and then making a new appearance in the past; on the other hand, it is necessary to eliminate the dogmatic understanding of Marxist jurisprudence, the addition of errors and the arbitrary interpretation of it. The classical Marxist writers who are not suitable for the reality of contemporary China should give up their theoretical judgment on certain specific situations and make clear the limits of the application of the theory of revolutionary legal system of Marxist jurisprudence and the theory of social construction of the rule of law. We should adhere to a scientific attitude and deal with the marginalization of leading ideas, and see clearly and eliminate the interference of all kinds of erroneous ideas. We are firmly opposed to the idea of enchanting Marxist jurisprudence. It is necessary to correct dogmatism with correct ideological line and set up the basic guiding principle of emancipating the mind, seeking truth from facts and keeping pace with the times. Take practice as the basic way to produce, test and develop the theory of law. To draw lessons from and absorb the outstanding achievements of legal civilization of various countries in the world reasonably, to enrich the legal theory with the useful ingredients after quenching. We will continue to strengthen the national characteristics of socialist jurisprudence with Chinese characteristics. Further excavate the achievements of legal civilization in the past dynasties, discard the dross, take the essence of it, and make rational use of those achievements which are of positive significance in the construction of the rule of law in China today. Through critically inheriting, continuously enriches the Chinese characteristic socialism law content. Strengthen the dissemination, realize the popularization of scientific theory. The dissemination of legal theory should be combined with the popularization of law such as publicity of law. The contents and requirements of the law of socialism with Chinese characteristics are popularized, concretized and visualized, so as to truly penetrate into the life of the common people and be understood and grasped by the broad masses. To cultivate and bring up a contingent of talented people who are politically reliable, have a solid foundation, are familiar with the basic level, are good at using mass language for theoretical interpretation, theoretical propaganda and theoretical popularization of education, Strengthen the socialist concept of the rule of law, spiritual education and popularization of government officials at all levels.
