【摘要】：法治(rule of law)是當(dāng)今世界最突出的合法化政治理想。然而,源自西方傳統(tǒng)的法治究竟是西方社會特有的現(xiàn)象還是整個人類社會的共同現(xiàn)象?西方的法治理論和西方國家的法治發(fā)展道路對于中國究竟有什么樣的意義?在一個沒有法治傳統(tǒng)的國家如何實現(xiàn)法治?作為地方性知識,中國的法治發(fā)展有什么特殊性?中國的法治發(fā)展有什么樣的社會動力和將面臨哪些困難?中國將走什么樣的法治發(fā)展道路?如何將執(zhí)政黨“建構(gòu)社會主義和諧社會”的戰(zhàn)略構(gòu)想與憲法中“依法治國,建設(shè)社會主義法治國家”的憲政方案有機(jī)地結(jié)合在一起,探索中國法治發(fā)展的理想模式?這些不僅是重大的理論問題,而且是重大的時代課題。正是對這個時代課題的理論回應(yīng)和現(xiàn)實關(guān)切,中國法學(xué)界創(chuàng)造性提出了構(gòu)建“和諧法治”的新命題,標(biāo)志著中國特色社會主義法治發(fā)展理想圖景破繭而出。 縱觀中國法治發(fā)展進(jìn)程,其每一階段無不發(fā)端于一定的社會經(jīng)濟(jì)生活條件。當(dāng)代中國正經(jīng)歷著由傳統(tǒng)社會向現(xiàn)代社會的歷史變遷和巨大轉(zhuǎn)型。在社會轉(zhuǎn)型不斷加快的背景下,在構(gòu)建和諧社會的時代主題中,中國法理學(xué)要推動法治思想在中國語境下的生長,并進(jìn)而實現(xiàn)中國法理學(xué)在國際結(jié)構(gòu)中的自主發(fā)展,就必須在審視中國特殊國情和本土資源的基礎(chǔ)上,繼承和發(fā)展西方法治文明的優(yōu)秀成果,推動形成具有中國特色的法治發(fā)展道路。法治的中國特色,不僅在于它要保障般意義上的正義、自由、秩序、效率,而且更要保障和諧。“和諧法治”的提出,正適應(yīng)了當(dāng)下中國法治建設(shè)的這種需求,充分體現(xiàn)著構(gòu)建社會主義和諧社會的戰(zhàn)略思想和中國特色社會主義的時代精神,代表著我國依法治國方略和法治國家目標(biāo)的歷史走向。正因如此,一段時間以來,“和諧法治”問題成為法學(xué)研究的重要領(lǐng)域,一些有洞見的研究厘清了許多理論問題,取得了很多開創(chuàng)性成果,推動了“和諧法治”研究的深入。但畢竟“和諧法治”的研究起步不久,對這個新范疇的研究還沒有引起足夠重視。因此,本文的研究目的,就是對這個新范疇作個整體性的探究,以期引起法學(xué)理論界對這個問題的進(jìn)一步關(guān)注 為了達(dá)到整體性探究的目的,本文從“和諧法治”這個核心概念出發(fā),從法治思想的知識脈絡(luò)、學(xué)術(shù)傳承和中國法治發(fā)展的本土資源著手,在分析、汲取現(xiàn)有研究成果基礎(chǔ)上,對這個新范疇的內(nèi)涵、特性、內(nèi)在理路、理論意象、實踐指向作一個整體性的討論,試圖開放出這個論域的一般性問題,形成“和諧法治”研究的整體性理論框架。本文從分析法的和諧價值入手,提出法的和諧價值的彰顯必然引起法價值體系的重構(gòu),法價值體系的重構(gòu)必定引起法律體系的重塑,而這正蘊(yùn)含或決定著中國特色社會主義法治的價值取向、基本原則、制度安排,指引和制約著對法律資源的社會性配置。和諧法治就是把法的和諧精神導(dǎo)入法律體系,以法的和諧價值融入法治發(fā)展的各領(lǐng)域和全過程,指導(dǎo)法治實踐,引領(lǐng)法治發(fā)展。和諧法治的要義在于建立一個自由有序、充滿活力的和諧社會,實現(xiàn)良法善治。同時,本文試圖從法治發(fā)展的西方傳統(tǒng)和中國探求兩條進(jìn)路,提出“和諧法治”不僅是推動法治思想在中國語境下生長的最新努力,也是中國法學(xué)參與或引領(lǐng)世界法律對話的一種理論范式,是中國法理學(xué)在國際結(jié)構(gòu)中的自主發(fā)展的最新成果。在西方法治傳統(tǒng)蛻變和中國法治發(fā)展面臨困境的雙重背景下,和諧法治范疇的提出和展開,是構(gòu)建具有中國特色、中國氣派、中國風(fēng)格和具有世界影響力的法學(xué)理論體系的嘗試,不僅將成為中國特色社會主義法治發(fā)展的理想圖景,而且也將成為重構(gòu)人類社會法律哲學(xué)和法律體系的起點。 從整體性的視角,本文對“和諧法治”問題作了一些新的論述,主要是：明確提出“和諧法治是中國特色社會主義法治發(fā)展的理想圖景”；首次對法的和諧價值的基本屬性進(jìn)行了討論,提出法的和諧價值具有統(tǒng)合性、超越性、社會本位性、非根據(jù)性的基本屬性；首次討論了法的和諧價值與法的正義、自由、人權(quán)、秩序、效率等基本價值的關(guān)系,提出了法的和諧價值導(dǎo)入與法價值體系重構(gòu)的問題；以“和諧法治”這個新范疇為基礎(chǔ),對這個新范疇的內(nèi)涵、特性、內(nèi)在理路、理論意象、實踐指向作一個整體性的討論、探究,開放出這個論域的一般性問題；對和諧法治生成的條件作了分析。 “和諧法治”范疇的提出具有重大的開創(chuàng)性意義。“和諧法治”是以主體性話語回應(yīng)時代課題的理想選項,體現(xiàn)了我國依法治國方略和法治國家目標(biāo)的歷史指向。“和諧法治”研究的展開和深入勢必會引發(fā)法本質(zhì)、法價值、法功能和法作用理論的變遷,引領(lǐng)我們轉(zhuǎn)換法治話語體系,進(jìn)而引起整個法律觀的重構(gòu),提升我們的法治觀念和法治實踐,豐富和創(chuàng)新建設(shè)社會主義法治國家的理想模式、歷史任務(wù)、實踐途徑。
