【摘要】：隨著現(xiàn)代社會發(fā)展,傳統(tǒng)以公平優(yōu)先、效率次之的司法糾紛解決機(jī)制愈發(fā)呈現(xiàn)出疲于應(yīng)付的態(tài)勢,準(zhǔn)此,就需要建立一種兼顧公平與效率的"準(zhǔn)司法"糾紛解決機(jī)制。相較于我國的行政調(diào)解制度而言,日本的行政調(diào)解取得了令人矚目的成就,通過借鑒日本經(jīng)驗(yàn),逐步推動我國行政調(diào)解制度的完善。
[Abstract]:With the development of modern society, the traditional judicial dispute resolution mechanism, which gives priority to fairness and takes second place in efficiency, is becoming more and more difficult to cope with. Therefore, it is necessary to establish a "quasi-judicial" dispute resolution mechanism which takes account of both fairness and efficiency. Compared with the administrative mediation system of our country, the administrative mediation in Japan has made remarkable achievements, and by drawing lessons from the experience of Japan, it has gradually promoted the perfection of the administrative mediation system in our country.
