【摘要】：肉刑是中國古代重要的刑罰制度。自漢文帝廢除肉刑后,關(guān)于肉刑的爭議從未間斷,宋代的肉刑議論則是整個過程中重要的一環(huán)。宋代肉刑爭議所體現(xiàn)出刑罰觀念既有對前人刑罰觀念的繼承,也有自身的獨創(chuàng),對后世刑罰理念產(chǎn)生深遠(yuǎn)影響。在宋人文集、《宋史》等文獻(xiàn)中存有大量關(guān)于士大夫反映肉刑議論及其法律觀念的史料。在梳理與回顧宋代刑罰制度、刑罰觀念、肉刑爭議及法律文化四方面的學(xué)術(shù)史及研究現(xiàn)狀基礎(chǔ)上,通過論述分析先秦及至宋代肉刑法律實踐、肉刑爭論及宋代出現(xiàn)肉刑爭論的原因,反映了宋代士大夫以下肉刑法律理念:士大夫因“圣賢之意,觀自然之理”的圣人制刑觀、“善刑惡則無憂,惡刑善則兇至”的善惡法律觀、儒家價值分殊的寬嚴(yán)法律觀及“有罪當(dāng)罰,無罪不罰”的刑罰虛實觀念。宋代士大夫關(guān)于肉刑爭論的法律理念與實踐對后世產(chǎn)生了巨大影響,主要有三個方面表現(xiàn):一是宋代以后大規(guī)模議復(fù)肉刑活動的停止,肉刑在制度與實際應(yīng)用方面有所恢復(fù);二是重刑主義得到發(fā)展,輕罪重刑、“刑以弼五教”制刑趨勢;三是理學(xué)“仁善”理論在刑罰適用中得到體現(xiàn)。宋代士大夫肉刑議論背后正是傳統(tǒng)法律觀念的特殊價值的反映。
[Abstract]:Corporal punishment is an important penalty system in ancient China. Since the abolition of corporal punishment by Emperor Wen of the Han Dynasty, the controversy on corporal punishment has never stopped, and the debate on corporal punishment in Song Dynasty is an important part of the whole process. The controversy of corporal punishment in Song Dynasty reflects that the concept of penalty not only inherits the former concept of punishment, but also has its own originality, which has a profound influence on the concept of penalty in later generations. In the collected works of Song Dynasty, the History of the Song Dynasty and other documents, there are a lot of historical materials about the scholars and officials reflecting the views on the punishment of flesh and their legal concepts. On the basis of combing and reviewing the academic history and current research status of penalty system, penalty concept, buttocracy dispute and legal culture in Song Dynasty, this paper discusses and analyzes the legal practice of corporal punishment from pre-Qin to Song Dynasty. The debate on corporal punishment and the reasons for the controversy of corporal punishment in Song Dynasty reflect the following legal concepts of corporal punishment in the Song Dynasty: the concept of saints' system of punishment for the sake of "the meaning of saints and saints, view of reason of nature", and "good punishment and evil punishment are not worryless," The concept of law of good and evil, the view of lenient and strict law with different value of Confucianism and the concept of criminal punishment, innocence and impunity. The legal ideas and practices of the scholars and officials in the Song Dynasty have had a great influence on the later generations, mainly in three aspects: first, after the Song Dynasty large-scale discussion on the cessation of the meat-penalty activities, the corporal punishment in the system and practical application has been restored; The second is the development of the doctrine of heavy punishment, the heavy punishment of misdemeanour, the tendency of making punishment by the five religions of pil, and the embodiment of the theory of benevolence and goodness of Neo-Confucianism in the application of punishment. It is the reflection of the special value of the traditional legal concept behind the discussion of the butchery punishment of the literati and officials in the Song Dynasty.
