論德國(guó)行政程序法中程序瑕疵理論之建構(gòu)與發(fā)展

【摘要】：德國(guó)透過(guò)解釋之方式,在個(gè)別法領(lǐng)域中例外承認(rèn)絕對(duì)的程序瑕疵,并在立法及司法實(shí)務(wù)上,特別在歐盟法的影響下,逐漸擴(kuò)大絕對(duì)程序瑕疵之態(tài)樣,賦予程序規(guī)定獨(dú)立的意義及價(jià)值。我國(guó)臺(tái)灣地區(qū)行政法學(xué)界及司法實(shí)務(wù)界對(duì)此較為陌生,但建立絕對(duì)程序瑕疵理論之契機(jī),或許可由"司法院"釋字第709號(hào)解釋為始,作為在我國(guó)臺(tái)灣地區(qū)發(fā)展絕對(duì)程序瑕疵理論之基石。
[Abstract]:By way of interpretation, Germany recognizes absolute procedural defects in the field of individual law, and in the legislative and judicial practice, especially under the influence of EU law, it gradually expands the pattern of absolute procedural defects. Endow procedures with independent meaning and value. However, the opportunity of establishing the theory of absolute procedural defects may be explained by the interpretation of "Judicial Court" No. 709. As the cornerstone of the development of absolute procedural defect theory in Taiwan, China.
