【摘要】：《法治及其本土資源》曾給法學(xué)界帶來一股清風(fēng),其寫作方式與同時期的法學(xué)作品頗為不同,它著眼于"從事理講法理",而不是抽象地講法理。從事理出發(fā),走向從中國社會出發(fā)、尊重社會創(chuàng)造的法理,這才是真正意義上的中國法理研究。這種研究訴諸常情、常理、常識,講述的是生活經(jīng)驗,而背后有理論視角,需要理論資源儲備,也需要社會科學(xué)知識和方法的運用,它最終會走向社科法學(xué)。社科法學(xué)研究的重要任務(wù)之一是重建中國法理學(xué),在一般性法律現(xiàn)象、法律關(guān)系之外討論中國的法律體制、法律運行等問題,在經(jīng)驗基礎(chǔ)上闡釋中國法治實踐。
[Abstract]:"Rule of law and its native resources" once brought a breeze to the legal circles, and its writing style is quite different from the legal works of the same period. It focuses on "engaging in the theory of law", rather than talking about the theory of law in an abstract way. Starting from the Chinese society and respecting the legal principles created by the society, this is the real study of Chinese jurisprudence. This kind of research appeals to the common sense, is about the life experience, but behind the theory angle of view, needs the theoretical resources reserve, also needs the social science knowledge and the method application, it will eventually go to the social science law. One of the important tasks of the study of social science law is to reconstruct Chinese jurisprudence, discuss Chinese legal system and legal operation outside of general legal phenomena and legal relations, and explain the practice of Chinese rule of law on the basis of experience.
