論法的和諧美

【摘要】:相反相成,對立統(tǒng)一,是形成和諧的根本原因。簡單來說,所謂“和諧”,就是矛盾對立的統(tǒng)一,雜多因素的相濟。和諧源于人性的根本需求,是人類社會永恒的價值追求。 依據(jù)馬克思在《1844年經(jīng)濟學(xué)——哲學(xué)手稿》中的思想,建立在勞動基礎(chǔ)上的人化自然過程是一個自然的人化、人的自然化的過程,它是整個人類文明的源泉。美就根源于人化自然過程人的本質(zhì)力量的對象化,它是人以直觀的方式對其本質(zhì)的把握。人的本質(zhì)力量指人在“自由自覺的活動”所能表現(xiàn)出的一切力量,它體現(xiàn)著人的主觀能動性對物質(zhì)世界客觀規(guī)律的把握,并在這種把握中由對立走向統(tǒng)一。因此,美就是和諧,就是主觀與客觀、真與善在對立中的統(tǒng)一,是人與自然、感性與理性諸雜多因素的相濟。 法,作為人類經(jīng)驗智慧結(jié)晶之一種,其產(chǎn)生發(fā)展也體現(xiàn)著人的本質(zhì)力量的不斷提升。因此,法中不僅有真、有善,還有美。和諧既是美的主要特征,又是法的價值追求,它構(gòu)成法與美的一個交匯點。法之和諧美就是真與善、感性與理性、人的主觀目的與客觀物質(zhì)規(guī)律的和諧之美。它取決于人性與生產(chǎn)方式在法律中的“耦合”,體現(xiàn)著人性與生產(chǎn)方式在雙向互動中的均衡。 在遠古時代,法與美最初的融合體現(xiàn)在古詩體法中。在法律以后的發(fā)展走向中,中西方呈現(xiàn)出了不同的法律樣態(tài),但和諧始終是其共同不變的價值追求。法之和諧美在中國的發(fā)展表現(xiàn)為“禮法的和諧之治”,在西方得益于眾多法學(xué)流派的相互碰撞與融合。 法之和諧美既體現(xiàn)為法的價值之美,表現(xiàn)在法的倫理靈魂,及其對秩序與正義的整體追求上,并具體落實為法對人與自我、人與自然、人與社會的調(diào)節(jié)。同時,法之和諧美又彰顯于法的嚴整形式之中,具體體現(xiàn)在法律體系、法律規(guī)則及法律程序設(shè)置自身及其相互之間和現(xiàn)實化運作過程中的統(tǒng)一協(xié)調(diào)。最后,法之和諧美還體現(xiàn)為價值與形式的辯證統(tǒng)一。包括權(quán)力與義務(wù)、權(quán)利與權(quán)力、權(quán)力與責(zé)任這些矛盾范疇本身的相反相成及相互之間的共依共存。
[Abstract]:On the contrary, unity of opposites is the fundamental reason for harmony. In short, the so-called "harmony" is the unity of contradictions and opposites, the combination of various factors.
According to Marx's thought in Economics-Philosophical Manuscript of 1844, the humanized natural process based on labor is a natural humanization, a process of human naturalization, and it is the source of the whole human civilization. Beauty is rooted in the objectification of the essential power of human beings in the humanized natural process, which is the essence of human beings in an intuitive way. Man's essential power refers to all the powers that man can display in his "free and conscious activities". It embodies man's subjective initiative in grasping the objective laws of the material world and in this grasp from opposition to unity. Therefore, beauty is harmony, the unity of subjectivity and objectivity, the unity of truth and goodness in opposition, and the unity of man and nature. The combination of sensibility and reason is mixed with many factors.
Law, as one of the crystallization of human experience and wisdom, its emergence and development also reflects the continuous improvement of human essential strength. Therefore, there is not only truth, goodness, but also beauty in law. Harmony is not only the main feature of beauty, but also the pursuit of value of law. It constitutes a intersection point of law and beauty. The harmonious beauty of law is truth and goodness, sensibility and rationality, and man's master. The beauty of harmony between objective object and objective material law depends on the coupling of human nature and mode of production in law, which reflects the balance between human nature and mode of production in the two-way interaction.
In ancient times, the initial fusion of law and beauty was embodied in the ancient poetic law. In the development trend after law, China and the West showed different patterns of law, but harmony has always been their common and unchangeable pursuit of value. The collision and integration of each other.
The harmony beauty of law is embodied in the value beauty of law, the ethical soul of law, the overall pursuit of order and justice, and the regulation of law to man and himself, man and nature, man and society. Finally, the beauty of harmony of law is embodied in the dialectical unity of value and form, including the opposites and coexistence of power and obligation, right and power, power and responsibility.
