【摘要】：美國的"定罪完善小組"制度是指地區(qū)檢察官辦公室在其內(nèi)部專門成立一個部門,指派檢察官、律師等協(xié)同調(diào)查可能發(fā)生的錯案,旨在發(fā)現(xiàn)、糾正并防止錯誤定罪制度。作為美國檢察機(jī)構(gòu)在推進(jìn)刑事錯案救濟(jì)過程中建立的一種新型制度,定罪完善小組具有獨(dú)立自主的組織結(jié)構(gòu)、靈活高效的案件審查、公開透明的運(yùn)作過程三項(xiàng)基本特征。至今,定罪完善小組取得了令人矚目的成就:在數(shù)量上,它成功地發(fā)現(xiàn)并糾正了很多的錯案;在措施上,它倡導(dǎo)并實(shí)施了防范錯案的政策改革;在理念上,它推動了檢辯雙方在錯案救濟(jì)上以合作取代對抗。定罪完善小組制度的實(shí)踐與創(chuàng)新對于當(dāng)前中國刑事錯案的救濟(jì),特別是通過強(qiáng)調(diào)檢察機(jī)關(guān)的主動性來推動刑事錯案的發(fā)現(xiàn)與糾正,具有非常積極的借鑒與啟示意義。
[Abstract]:The "conviction group" system in the United States refers to the establishment of a special department within the district prosecutor's office to assign prosecutors and lawyers to cooperate in investigating possible errors, with the aim of finding, correcting and preventing the erroneous conviction system. As a new system established by American procuratorial organs in the process of promoting the remedy of criminal error cases, the conviction group has three basic characteristics: independent organizational structure, flexible and efficient case review, and open and transparent operation process. To date, the conviction improvement team has achieved remarkable results: in terms of quantity, it has successfully detected and corrected many wrong cases; in measures, it has advocated and implemented policy reforms to prevent wrongdoings; and conceptually, It has pushed the prosecution and the defense to replace confrontation with cooperation in the remedy of false cases. The practice and innovation of the conviction and perfection of the group system have a very positive significance for reference and enlightenment for the relief of the current criminal error cases in China, especially through emphasizing the initiative of the procuratorial organs to promote the discovery and correction of the criminal error cases.
