【摘要】：歷史的變遷催生了文明的進(jìn)步,人類文明由"無序隨性"變"有序約束",法律制度的發(fā)展是其最好的見證者。西班牙憲法的發(fā)展伴隨了西班牙一系列重要的歷史事件,其發(fā)展衍變具有自然演變、時(shí)代推動和節(jié)點(diǎn)作用多重特點(diǎn)�？梢哉f,西班牙憲法框架的建立,正是西班牙社會進(jìn)步和發(fā)展的結(jié)果。西班牙作為資產(chǎn)階級的君主立憲國家,歷史上也曾經(jīng)歷過短暫的共和國時(shí)期。從1812年西班牙誕生了首部憲法,到西班牙全民公投產(chǎn)生了最后一部憲法,這一期間新憲法不斷代替舊憲法,也造就了不少短命的憲法。從近代君主制時(shí)期的憲法、共和國時(shí)期的憲法,直到今天尚在發(fā)揮效力的最現(xiàn)代、進(jìn)步的1978年憲法,無不是當(dāng)時(shí)社會歷史條件的產(chǎn)物,無疑都展現(xiàn)了那個時(shí)代的社會矛盾和西班牙人民的抗?fàn)?也確立了當(dāng)時(shí)歷史的政治體制,以維護(hù)其政治統(tǒng)治,實(shí)現(xiàn)社會穩(wěn)定。可以說一個個西班牙憲法框架的建立,也推動了西班牙社會的不斷進(jìn)步和發(fā)展。本文通過對西班牙憲法變遷的分析,梳理了西班牙憲政進(jìn)化的路徑,并依據(jù)憲法文本,研究分析了近現(xiàn)代西班牙憲政制度的發(fā)展演進(jìn)過程。文章以歷史唯物主義和辯證唯物主義為指導(dǎo),充分利用法律史學(xué)、憲法學(xué)、政治學(xué)等學(xué)科的相關(guān)研究成果,綜合采用了文獻(xiàn)資料分析、歷史分析、比較分析等研究方法,系統(tǒng)梳理了西班牙從君主制時(shí)期到共和國時(shí)期、現(xiàn)代社會憲法變遷的歷程、背景及原因,并對西班牙憲法下議會制度、司法制度以及公民基本權(quán)利的發(fā)展演進(jìn)等做了重點(diǎn)論述和綜合解釋,以期能展現(xiàn)西班牙憲法和時(shí)代共同發(fā)展變遷的成長史,推動對西班牙相關(guān)研究的發(fā)展。
[Abstract]:The change of history gave birth to the progress of civilization. Human civilization changed from "disorder and randomness" to "orderly restraint", and the development of legal system was its best witness. The development of Spanish Constitution has been accompanied by a series of important historical events in Spain. It can be said that the establishment of Spain's constitutional framework is the result of Spanish social progress and development. Spain, as a constitutional monarchy of the bourgeoisie, experienced a brief period of republic in its history. From the birth of the first constitution in Spain in 1812 to the final constitution in a referendum in Spain, the new constitution replaced the old one and created a number of short-lived constitutions. From the constitution of the modern monarchy and the constitution of the Republic to the most modern, progressive 1978 constitution, which is still in effect today, it is the product of the social and historical conditions at that time. There is no doubt that the social contradictions of that era and the resistance of the Spanish people, but also established the political system of the history of that time, to maintain its political rule, to achieve social stability. It can be said that the establishment of a Spanish constitutional framework has also promoted the continuous progress and development of Spanish society. Based on the analysis of the constitutional changes in Spain, this paper combs the path of constitutional evolution in Spain, and according to the text of the constitution, studies and analyzes the development and evolution of the constitutional system in modern Spain. Guided by historical materialism and dialectical materialism, the article makes full use of the relevant research achievements in the fields of legal history, constitutional law, political science and so on, and synthesizes the methods of literature analysis, historical analysis, comparative analysis, etc. This paper systematically combs the history, background and reasons of constitutional changes in modern society from the period of monarchy to the period of republic, and analyzes the parliamentary system under Spanish constitution. The judicial system and the development and evolution of citizens' basic rights are emphasized and comprehensively explained in order to show the growing history of the common development and changes of the Spanish Constitution and the times and to promote the development of relevant studies in Spain.
