【摘要】：赫善心是德國在青島建立的青島特別高等專門學堂(俗稱德華大學)法政科的法律講師,除了他的中文名字和他所撰寫的《中國新刑律論》,中國學者長期以來對他所知甚少。他在清末修律的過程中對保守派持支持的立場,被有的學者批判為是違背了良心。近年新發(fā)現(xiàn)的赫善心的檔案資料和他的著述證實了中國學者對這位法律史上失蹤者的批判有失偏頗。事實上,他與作為改革派顧問的日本學者岡田朝太郎同為德國刑法巨擘李斯特的弟子,而他本人還是20世紀初期德國法學界在研究法律技術方面的重要學者。在當時德國立法法學興起的大背景下,他對于中國清末修律方向和原則發(fā)表的看似保守的觀點,完全源自于他的學術自信。他的思想實質(zhì)上與19世紀后期德國自然主義法學的立場有關,并且建立在對德意志數(shù)百年來引入外國法歷史經(jīng)驗的總結(jié)基礎上,因此是有理有據(jù),嚴肅真誠的。
[Abstract]:He Shanxin is a law lecturer in the Law Department of Qingdao Special higher School (commonly known as Dehua University) established by Germany in Qingdao. Apart from his Chinese name and his "the New Criminal Law of China", Chinese scholars have known him very little for a long time. His support for conservatives in the process of law revision in the late Qing Dynasty was criticized by some scholars as a violation of conscience. The newly discovered archives and his writings confirm that the Chinese scholar's criticism of the missing man in the history of law is biased. In fact, he was a disciple of the German criminal law giant Liszt along with the Japanese scholar Taro Okada, who was also an important scholar in the field of legal technology in Germany in the early 20th century. Against the background of the rise of German legislative jurisprudence at that time, his seemingly conservative views on the direction and principles of law revision in the late Qing Dynasty came from his academic self-confidence. His thought is essentially related to the position of German naturalistic jurisprudence in the late 19th century and is based on the summary of the historical experience of introducing foreign law into Germany over the past several hundred years, so it is reasonable and serious and sincere.
