【摘要】：從1902年到21世紀初,中國法治道路經(jīng)歷了四個轉(zhuǎn)變,把百年變革的歷程置于文明轉(zhuǎn)型的視野之下,我們將會有更加深刻的認識:傳統(tǒng)改良之路是在西方文明的緊逼下被迫進行的,保留了相當?shù)闹袊蓚鹘y(tǒng);全面西化之路伴隨著資產(chǎn)階級政權(quán)的成立而開始,忽略了中國傳統(tǒng)文化的重要作用;蘇聯(lián)道路則隨著無產(chǎn)階級政權(quán)執(zhí)政而開始,忽視了民主法治;當下的中國特色社會主義法治道路,是從中國實際出發(fā)又借鑒了商工文明法治優(yōu)越性的法治道路。百年變革背后深刻的事實是,中國法治的發(fā)展受著西方商工文明向中國擴張這一歷史潮流的推動。
[Abstract]:From 1902 to the beginning of the 21st century, the road of China's rule of law has undergone four changes, putting the course of the century-old transformation under the vision of the transformation of civilization. We will have a deeper understanding: the road of traditional improvement was forced to take place under the pressure of Western civilization, and a considerable amount of Chinese legal tradition has been retained; the road to full westernization began with the establishment of the bourgeois regime. Ignoring the important role of Chinese traditional culture; the Soviet road began with the ruling of the proletarian regime, ignoring democracy and the rule of law; and the current road of socialist rule of law with Chinese characteristics, It is the rule of law road that starts from the Chinese reality and draws lessons from the commercial industry civilization rule by law superiority. The profound fact behind the century-old reform is that the development of China's rule of law is driven by the historical trend of western commercial and industrial civilization expanding into China.
