【摘要】：明代處于中國古代封建社會(huì)的后期,是此時(shí)期一個(gè)承前啟后的重要朝代。它上承漢唐之風(fēng)、宋元之志,下啟有清一代。其諸多制度在歷代發(fā)展的基礎(chǔ)之上,又歷經(jīng)明代二百余年地不斷改革,較之于歷代都趨于成熟、完善,而恤囚制度既是其中之一。 明代的恤囚制度主要包括審錄清獄、贖罪恤刑、赦宥、法外憫囚、以及“八議”等方面。它是在儒家思想的指導(dǎo)下,繼承中國古代法制傳統(tǒng),從宣示仁懷、維護(hù)社會(huì)穩(wěn)定、維系封建統(tǒng)治的最根本目的出發(fā),對囚犯的刑罰、監(jiān)獄生活等進(jìn)行撫恤、憐憫,并不斷完善、逐漸形成的一整套完整、系統(tǒng)的治獄制度。 明代的恤囚制度是明代治獄制度不可或缺的一項(xiàng)重要內(nèi)容,客觀上它對減輕囚犯的疾苦、保障囚犯的合法權(quán)益、保證囚犯的生命安全、人身健康起到積極作用。明代的恤囚制度在客觀上體現(xiàn)出明代統(tǒng)治者以人為本、寬刑恤囚的治獄思想,在中國的法制史上具有重要意義。但是,由于主觀因素和時(shí)代的局限性,其依然存在諸多不足之處。
[Abstract]:The Ming Dynasty, in the late stage of ancient Chinese feudal society, was an important dynasty connecting the past and the future. It inherited the style of Han and Tang dynasties, Song and Yuan dynasties, and the Qing Dynasty. On the basis of the development of the past dynasties, many of its systems have undergone more than 200 years of continuous reform in the Ming Dynasty. Compared with the successive dynasties, the system of compassionate prisoners is one of them. The system of compassionate prisoners in Ming Dynasty mainly includes the trial of clear prison, atonement of punishment, pardon, outside of the law, and "eight issues". Under the guidance of Confucianism, it inherits the tradition of ancient Chinese legal system, proceeding from the most fundamental purpose of declaring benevolence, maintaining social stability and maintaining feudal rule, compassionate, and constantly perfecting the punishment of prisoners, prison life, etc. A complete and systematic system of prison administration gradually formed. The system of compassionate prisoners in Ming Dynasty is an indispensable part of the prison system in Ming Dynasty. Objectively, it plays a positive role in alleviating the suffering of prisoners, protecting the legitimate rights and interests of prisoners, ensuring the life safety and personal health of prisoners. The system of compassionate prisoners in the Ming Dynasty objectively reflects the ruling thought of the rulers of the Ming Dynasty, which is of great significance in the history of China's legal system. However, due to subjective factors and limitations of the times, it still has many shortcomings.
