【摘要】：“狀族”法律文書名詞即含有單音詞“狀”的法律文書名詞聚類,它們是古文書名詞細(xì)化在法律領(lǐng)域的分支,是中國(guó)古代文檔名詞的一個(gè)重要組成部分�！盃钭濉狈晌臅~,產(chǎn)生較晚,且大多數(shù)名詞的使用并不具備隨著時(shí)間變化,使用頻率增高,使用范圍擴(kuò)大等一般古代文檔名詞的特點(diǎn),很多法律文書名詞內(nèi)涵較為單一,自誕生就作為古代法律文書名詞來(lái)使用,專業(yè)性極強(qiáng)�！盃钭濉狈晌臅~研究,是中國(guó)古代文檔名詞研究的重要分支,是中國(guó)古代法律史的研究的一部分,為中國(guó)古代檔案史的研究提供新的視角。本文主要運(yùn)用語(yǔ)言計(jì)量學(xué)和文獻(xiàn)分析相結(jié)合的寫作手法,對(duì)“狀族”內(nèi)重要的法律文書名詞,如“訴狀”“稟狀”“保狀”“結(jié)狀”“驗(yàn)狀”“首狀”“正狀”等名詞進(jìn)行簡(jiǎn)要分析。對(duì)古代司法審判過(guò)程中產(chǎn)生的法律文書類型進(jìn)行分類,最終產(chǎn)生互控類、證據(jù)類和結(jié)案類三大類目的“狀族”法律文書架構(gòu)了本論文,對(duì)族內(nèi)重點(diǎn)法律文書名詞依據(jù)其使用情況、發(fā)展內(nèi)涵以及應(yīng)用領(lǐng)域的分析,總結(jié)出在整個(gè)中國(guó)古代歷史進(jìn)程中,“狀族”法律文書名詞所具有的特點(diǎn)和演變規(guī)律,從而闡明“狀族”法律文書名詞在文檔名詞族類中所占據(jù)的重要地位。
[Abstract]:The legal document nouns of "like clan", which contain monosyllabic words "like", are the branches of the ancient Chinese characters in the field of law, and they are an important part of the ancient Chinese document nouns. The legal document nouns of "like clan" come into being relatively late, and most nouns do not have the characteristics of general ancient document nouns, such as changing over time, increasing the frequency of use, expanding the scope of use, and so on, many legal documents nouns have relatively single connotation. Ever since its birth, it has been used as a noun of ancient legal documents. As an important branch of the study of ancient Chinese document nouns, the study of legal documents of "like clan" is a part of the study of ancient Chinese legal history, which provides a new angle of view for the study of the history of archives in ancient China. This paper mainly uses the writing technique of combining linguistic metrology and literature analysis to analyze the important legal clerical nouns in the "form clan". Such as "petition", "guarantee", "knot", "check", "first", "positive" and so on. The author classifies the types of legal documents produced in the ancient judicial process, and finally produces three kinds of legal documents, I. E. mutual control, evidence and closing cases, which constitute the framework of this paper. Based on the analysis of the usage, development connotation and application field of the key legal document nouns in the clan, this paper summarizes the characteristics and evolution rules of the legal document nouns of the "like clan" in the course of the whole ancient Chinese history. In order to clarify the "like" legal documents nouns in the document noun category occupies an important position.
