【摘要】：依托迅速崛起的網(wǎng)絡(luò)公共領(lǐng)域,民間社會在為法制改革轉(zhuǎn)型提供充沛動力的同時,也與政治國家展開了以輿論競爭為主要形式的權(quán)力之爭。在"改革開放"的宏觀背景和"web 2.0革命"的時代潮流下,國家與社會權(quán)力再分配的歷史進程有其必然性,但民間社會并無能力主導(dǎo)法制改革,黨的領(lǐng)導(dǎo)才是法制改革轉(zhuǎn)型走向成功的關(guān)鍵。在堅持黨的領(lǐng)導(dǎo)的前提下擴大社會參與,要求政府按照十八屆三中全會的部署,創(chuàng)新社會治理。通過社會治理創(chuàng)新,開辟"公私合作"的空間和道路,可能是迎接法制改革轉(zhuǎn)型的必要選擇。
[Abstract]:Relying on the rapid rise of the network public domain, civil society not only provides abundant power for the legal system reform transformation, but also launches the power struggle with the political state in the form of public opinion competition as the main form. Under the macro background of "reform and opening up" and the trend of "web 2.0 revolution", the historical process of redistribution of state and social power has its inevitability, but civil society has no ability to lead the legal system reform. The party's leadership is the key to the success of the legal system reform. Under the premise of adhering to the Party's leadership, the government is required to innovate social governance in accordance with the plan of the third Plenary session of the 18th CPC Central Committee. Through the innovation of social governance and opening up the space and road of "public-private cooperation", it may be the necessary choice to meet the transformation of legal system reform.
