【摘要】：我國司法解釋是根據(jù)全國人大常委會關于法律解釋的有關決議,由最高司法機關對如何具體運用法律所作的具有普遍約束力的解釋性法律文件。作為一種重要的法律淵源,它彌補了立法工作的粗略與滯后,一定程度上解決了司法機關在實際工作中無法可依的狀況以及由于法律規(guī)定過于原則而帶來的難以適用的問題。但我國的司法解釋在發(fā)展過程中具有強烈的本土色彩,存在著不少有待改進的地方。作者在認真審視我國司法解釋現(xiàn)狀的基礎上,著重分析了我國司法解釋的存在問題,并從主體、內(nèi)容、形式等方面,就現(xiàn)有體制下矯正和完善我國的司法解釋提出了建議意見,旨在推動我國司法解釋的改革發(fā)展。作者認為,從長遠來看,我國的司法解釋應和其它法律制度一樣,都要順應國內(nèi)外先進法治理念及其不斷發(fā)展的潮流趨勢,逐步融入國際司法的大家庭。在現(xiàn)有條件下,最起碼也要遵循我國現(xiàn)行的政治體制、權(quán)力機制和司法制度。鑒于中國特色的司法解釋可能在較長時間內(nèi)還會存在,因而適當改革現(xiàn)行司法解釋制度,切實解決其不規(guī)范、不合理、不合法之處,是推進我國法治建設的一項重要任務。
[Abstract]:The judicial interpretation of our country is a universal binding interpretative legal document made by the supreme judicial organ on how to use the law according to the relevant resolutions of the standing Committee of the National people's Congress on legal interpretation. As an important source of law, it makes up for the rough and lagged legislative work, to some extent, it solves the problems that the judicial organs can not follow in the actual work and that are difficult to apply because the legal provisions are too principled. However, the judicial interpretation of our country has strong local color in the process of development, and there are many areas to be improved. On the basis of carefully examining the present situation of judicial interpretation in China, the author emphatically analyzes the existing problems of judicial interpretation in our country, and puts forward some suggestions on how to correct and perfect the judicial interpretation under the present system from the aspects of subject, content and form. The aim is to promote the reform and development of judicial interpretation in China. The author holds that, in the long run, the judicial interpretation of our country should, like other legal systems, conform to the advanced concept of the rule of law at home and abroad and the trend of its continuous development, and gradually merge into the family of international justice. Under the present conditions, we should at least follow our current political system, power mechanism and judicial system. In view of the fact that judicial interpretation with Chinese characteristics may still exist for a long time, it is an important task to properly reform the current judicial interpretation system and effectively resolve its irregularity, irrationality and illegality.
