【摘要】：中俄多式聯(lián)運利用北方海航道的優(yōu)勢以提升其經濟效益的同時,也面臨著更為復雜的法律適用風險。中俄兩國相關立法的差異以及北方海航道的特殊性,極大地影響著中俄多式聯(lián)運當事人在多式聯(lián)運經營人責任承擔方式、北方海航段運輸限制性規(guī)范、遲延交付以及保險等問題上的法律適用選擇效果。當事人選擇適用不同的法律將面臨不同的風險。明晰法律適用風險,并在此基礎上適用適宜的法律或對相關的爭議問題事先做出明確約定,將有助于保障中俄多式聯(lián)運當事人的權益,進而促進中俄多式聯(lián)運的發(fā)展。
[Abstract]:Chinese and Russian multimodal transport takes advantage of the advantages of northern sea lanes to improve its economic benefits, but also faces more complicated risks of legal application. The differences between the relevant legislation of China and Russia and the particularity of the Northern HNA Channel greatly affect the way the parties to multimodal transport in China and Russia bear the responsibility of the multimodal transport operators, and the restrictive transport regulations of the Northern HNA section. Effect of choice of legal application on issues such as delay in delivery and insurance. Parties choose to apply different laws will face different risks. It is helpful to protect the rights and interests of Chinese and Russian parties to multimodal transport and to promote the development of multimodal transport in China and Russia.
