【摘要】：親屬相隱在中國(guó)歷史上是一項(xiàng)非常重要的法律原則,其萌生于春秋時(shí)期,經(jīng)過(guò)兩漢、南北朝,尤其在隋代的充實(shí),在唐律中形成了一個(gè)完備的規(guī)范系統(tǒng)；直至清末變法前,其內(nèi)容并沒(méi)有發(fā)生大的變化。清末修律引進(jìn)西方法律,它被改造后保留了下來(lái)；直至民國(guó)時(shí)期,它依然存在于法律之中。新中國(guó)建立后,親屬相隱淡出于中國(guó)法律界的研究視野；至今,親屬相隱在我國(guó)仍未入法,而國(guó)外諸多國(guó)家的刑事法律領(lǐng)域卻規(guī)定了親屬相隱原則。盡管中國(guó)古代的親屬相隱與西方國(guó)家的親屬相隱依據(jù)和目標(biāo)有所不同,但其內(nèi)在的理論依據(jù)仍然具有一致性。從倫理道德角度來(lái)講,它是對(duì)人性的尊重和親情的維護(hù)；從法理角度來(lái)看,它實(shí)質(zhì)上是親屬權(quán)利的體現(xiàn),并維護(hù)社會(huì)正義；從刑法學(xué)理論著手,它出于刑法期待可行性理論的要求�？傊�,親屬相隱源于人性,并直接體現(xiàn)為對(duì)親情的維護(hù),在任何歷史時(shí)期、任何國(guó)家、任何的法系,都有其存在的正當(dāng)性。從我國(guó)目前司法實(shí)踐和社會(huì)發(fā)展目標(biāo)來(lái)看,具有在刑事法律中確立親屬相隱的必要性、可行性和實(shí)效性,應(yīng)該適時(shí)、逐步推進(jìn)親屬相隱回歸刑事法律立法,恰當(dāng)?shù)亟缍ㄏ嚯[親屬的范圍、可以相隱的犯罪行為以及允許的隱匿犯罪的方式。
[Abstract]:Relative concealment is a very important legal principle in Chinese history. It originated in the Spring and Autumn period. After the enrichment of the Han Dynasty, the Southern and Northern dynasties, especially in the Sui Dynasty, a complete normative system was formed in the Tang Dynasty; until the end of the Qing Dynasty, the law was reformed. Its content has not changed greatly. In the late Qing Dynasty, the law was introduced into western law, and it survived after being reformed; until the period of the Republic of China, it still existed in the law. After the founding of New China, the relatives' concealment faded out of the research field of Chinese legal profession. Up to now, the relatives' concealment has not entered the law in our country, but the criminal law field of many foreign countries has stipulated the principle of "kinship" and "mutual concealment". Although the hidden basis and goal of relatives in ancient China are different from those in western countries, their internal theoretical basis is still consistent. From the perspective of ethics and morality, it is the respect for human nature and the maintenance of kinship; from the legal point of view, it is essentially the embodiment of the rights of relatives and the maintenance of social justice; from the theory of criminal law, It is based on the expectation of feasibility theory of criminal law. In a word, relatives' concealment originates from human nature and is directly reflected in the maintenance of kinship. In any historical period, any country and any legal system have their own legitimacy of existence. From the current judicial practice and social development goal of our country, it is necessary, feasible and effective to establish the relative concealment in the criminal law. Properly define the scope of relatives, can be hidden criminal acts and allowed to conceal the way the crime.
