【摘要】：法國勞動部長米莉雅姆 埃爾 庫姆里(Myriam El Khomri)于2016年2月頒布了《庫姆里法案》。這項(xiàng)法案將集體談判中關(guān)于工作時間的談判落實(shí)到企業(yè)內(nèi)部、設(shè)置了勞資賠償?shù)纳舷?并明確了辭退員工給予經(jīng)濟(jì)補(bǔ)償?shù)臈l件。該法案遭到了法國普通民眾的反對。在法國爆發(fā)了大規(guī)模的游行示威活動甚至在游行中出現(xiàn)暴力行為。利用法國憲法賦予的特殊權(quán)利,瓦爾斯政府在沒有經(jīng)過議會投票的情況下通過了這項(xiàng)法案。本文將通過歷史研究、文件綜述和對比探究該項(xiàng)法案的特殊性所在,借助數(shù)據(jù)分析和政治學(xué)理論解釋為何法國政府不顧民眾反對,執(zhí)意推行《庫姆里法案》,推動集體談判改革并且探究該法案未來的走向。本文將分為三部分進(jìn)行闡述:第一部分將介紹《庫姆里法案》的合法化過程,抗議活動的演變以及和之前改革相比,本次改革的特殊性所在;第二部分將介紹法國的集體談判體系以及解釋政府為何要推動此次改革;第三部分將指出《庫姆里法案》中關(guān)于集體談判改革帶來的可能影響。
[Abstract]:The French Minister of Labour, Myriam El Khomri, promulgated the Koumry Act in February 2016. The bill puts collective bargaining on working hours into practice, sets a cap on labor compensation and defines the conditions under which employees can be sacked for financial compensation. The bill met with opposition from ordinary French citizens. Massive demonstrations broke out in France and even violence. Using the special powers granted by the French Constitution, the Valls government passed the bill without a parliamentary vote. This paper will explore the particularity of the bill through historical research, document review and comparison, and explain why the French government disregards popular opposition with the help of data analysis and political science theory. Insist on the Coomery Act, promote collective bargaining reform and explore the future direction of the Act. This article will be divided into three parts to elaborate: the first part will introduce the legalization process of the "Koumry Act", the evolution of protest activities and compared with the previous reform, the particularity of this reform; The second part will introduce the French collective bargaining system and explain why the government wants to promote the reform. The third part will point out the possible impact of the collective bargaining reform in the Coomery Act.
