唐代“和離”制度及啟示研究

【摘要】:唐代“和離”制度是指夫妻雙方因為在感情中出現(xiàn)不能調(diào)和的分歧而協(xié)議解除婚姻狀態(tài)的一種離婚制度,對于婚姻雙方當(dāng)事人是否選擇離婚的決定是夫妻雙方共同作出的,是雙方兩廂合意的結(jié)果,是對于生活現(xiàn)狀不能繼續(xù)和睦下去而自愿作出的選擇,不存在強迫的意志,也不允許單方面作出決定從而強加給對方。所謂“和離”也就是指通過協(xié)議作出離婚的決定。而這種協(xié)議離婚的制度所依據(jù)的律文最早記載在《唐律疏議》之中:“如果夫妻在婚姻生活中不能夠繼續(xù)和睦相處,雙方協(xié)議解除婚姻關(guān)系,這種情況并不需要承擔(dān)法律責(zé)任。” “和離”制度這一律文正式入冊出現(xiàn)在唐代,這一制度的出現(xiàn)在當(dāng)時的唐代是婚姻法的創(chuàng)新,作為一種新的離婚形式,是前人婚姻生活經(jīng)驗的累積,是對唐代立法的新創(chuàng)舉,也是對后世婚姻形態(tài)的先河性開拓。《唐律·戶婚》對于離婚做了三種不同形式的定義,第一是“和離”,系出于男女自愿的協(xié)議離婚,也就是類似于當(dāng)今社會的離婚制度;第二是“出妻”,是男方單方面作出休妻決定解除婚姻關(guān)系的制度,通常是作“七出”的規(guī)定,是對女方片面壓制的封建制度;第三便是強制離婚,是指發(fā)生了國家法律強制解除婚姻的事由而強制解除婚姻形態(tài)。其中“和離”制度便是唐代社會生活中典型的離婚形式,涵蓋了我國歷史上法律體系的層層面面,本文謹(jǐn)依照傳統(tǒng)禮教的各種規(guī)范立足于對現(xiàn)實問題的多方位考察,通過深入解析古今法制文化中的離婚形式來進(jìn)一步研究唐代“和離”制度的歷史創(chuàng)舉所帶來的特殊價值,而這種帶有絕對中國文化色彩的法系意義中的進(jìn)步對于傳統(tǒng)離婚制度也是一種應(yīng)有的補充。同時,我國古代起便是以禮治國,而在這種法治體系中家庭作為社會生活的基礎(chǔ)單位,代表著婚姻對于整個社會的意義,本文中亦是從現(xiàn)實出發(fā),通過引用唐代文獻(xiàn)記載中的諸多案例以及“放妻書”這一具有典型代表性的實物典籍為基礎(chǔ),分析“和離”制度的現(xiàn)世性,從而進(jìn)一步分析研究唐代“和離”制度的思想文化淵源以及時代背景,并總結(jié)其對當(dāng)代婚姻制度制定實施過程中和諧發(fā)展的啟示 。本文通過分析唐代和離制度的思想根源,探討和離制度在唐代的實施情況,并以唐代文獻(xiàn)記載的案例和敦煌出土的七件放妻書為基礎(chǔ),分析和離的程序,研究和離制度形成的原因以及對唐代社會的影響,以期對當(dāng)今婚姻法的制定實施以及社會的和諧發(fā)展有所啟示。第一部分是重在分析唐代“和離”制度的思想淵源及其產(chǎn)生的時代背景,封建禮教下的婚姻觀反映在了唐律律文的規(guī)定之中。第二部分主要以唐代文獻(xiàn)記載的案例和敦煌出土的七件放妻書為基礎(chǔ)研究唐代和離制度,分析和離案例與律文的差異以及差異存在的原因。通過細(xì)致分析每一篇唐代和離文書——放妻書的文字、結(jié)構(gòu)等,研究放妻書的作用,探討和離的程序以及和離制度之下唐代社會的離婚狀況。第三部分重點從唐代“和離”制度的歷史評價上去評議唐代“和離”制度本身的影響及地位,它不僅在唐代產(chǎn)生了創(chuàng)新性的影響,對于后世的實踐意義也是可圈可點,無論從哪個角度來看,唐代的“和離”制度都有著歷史和現(xiàn)世都不可忽略的價值意義。
[Abstract]:The "and the departure" system in the Tang Dynasty refers to a divorce system that the husband and wife agree to dissolve their marital status because of their disagreement in their feelings. Whether the decision of the parties to choose a divorce is the common result of the couple, is the result of the consensual two sides of the two sides, and can not continue to be in harmony with the present situation of life. Voluntarily, there is no forced will or a unilateral decision to be imposed on each other. The so-called "and away" means a decision to make a divorce through an agreement. The law on which the system of divorce is based is first recorded in the "Tang law": "if the husband and wife are not able to follow in their marriage life." It is a new form of marriage, which is a new form of divorce, the accumulation of the experience of the marriage and life of the predecessors, and the legislation of the Tang Dynasty. The new pioneering work is also a pioneering work on the form of later marriage. < Tang Law > household marriage > for divorce. Three different forms of divorce are defined. The first is "and divorced". It is a voluntary divorce between men and women, that is, the divorce system similar to today's society; the second is the "out of wife", which is the man's unilateral decision to divorce his wife and decide to terminate the marriage customs. The system, usually a rule of "seven out", is a feudal system that oppresses one woman unilaterally; the third is compulsory divorce, which refers to the compulsory dissolution of marriage in the state law, which is a typical form of divorce in the social life of the Tang Dynasty and covers the history of our country. In accordance with the various norms of the traditional etiquette, this article, based on the various norms of the traditional etiquette, is based on the multi-directional investigation of the practical problems. Through the in-depth analysis of the form of divorce in the ancient and modern legal culture, this paper further studies the special value brought by the historical creation of the "and the" system in the Tang Dynasty, and this kind of legal system with absolute Chinese cultural color. The progress in the traditional divorce system is also a supplement to the traditional divorce system. At the same time, in ancient China, the family is the basic unit of social life, which represents the significance of marriage to the whole society. In this article, this article also starts from the reality and quotes a lot of cases recorded in the Tang Dynasty. On the basis of the typical and representative books of real objects, this paper analyzes the present nature of the "and the divorcing" system, thus further analyzes and studies the ideological and cultural origins and the background of the Tang Dynasty, and summarizes its enlightenment to the harmonious development of the establishment and implementation of the contemporary marriage system. This article through the analysis of the Tang Dynasty And the ideological root of the system, and the implementation of the system in the Tang Dynasty, and based on the cases recorded in the Tang Dynasty and the seven books of Dunhuang unearthed, the analysis and departure procedures, the reasons for the formation of the system and the influence on the society of the Tang Dynasty, with a view to the formulation and implementation of the present marriage law and the harmonious development of the society. The first part is to analyze the ideological origin and the background of the Tang Dynasty's "and" system. The concept of marriage under the feudal ethics is reflected in the regulation of the law of the Tang Dynasty. The second part mainly studies the Tang Dynasty and the system on the basis of the seven pieces of wife books unearthed in Dunhuang. In the third part, the third part emphasizes the historical evaluation of the "harmony" system in the Tang Dynasty. On the influence and position of the Tang Dynasty, it not only has an innovative influence on the Tang Dynasty, but also has a remarkable significance for the practical significance of the later generations. From any point of view, the system of "and the departure" of the Tang Dynasty has the value value which can not be ignored in history and the present world.
