【摘要】：中國共產(chǎn)黨政治權(quán)威是社會主義法治建設(shè)的根本保證,但流弊數(shù)千年的權(quán)大于法的思想和行為嚴(yán)重阻滯了中國的法治建設(shè)。習(xí)近平提出"把權(quán)力關(guān)進(jìn)制度的籠子里",其核心要義是實現(xiàn)依法治權(quán),抓住了法治建設(shè)的關(guān)鍵。中國特色社會主義法治建設(shè)已正式破題,既要依法治黨,黨必須在憲法和法律范圍內(nèi)活動;又要人權(quán)入憲,倡導(dǎo)內(nèi)含法治的社會主義核心價值觀;還要啟動頂層設(shè)計法治體系和國家監(jiān)察體制改革,為全面依法治國夯實體制基礎(chǔ)。
[Abstract]:The political authority of the Communist Party of China is the fundamental guarantee of the construction of the socialist rule of law, but the thought and behavior that the power of the Communist Party of China outweighs the law for thousands of years seriously blocks the construction of the rule of law in China. Xi Jinping puts forward "putting the power in the cage of the system", the core of which is to realize the rule of law and seize the key to the construction of the rule of law. The construction of the rule of law of socialism with Chinese characteristics has broken down formally, the Party must not only run the party according to law, but also must act within the scope of constitution and law, and advocate the socialist core values of rule of law by entering human rights into the constitution. The top-level design of the legal system and the reform of the state supervision system should also be initiated to consolidate the institutional foundation for the overall administration of the country according to law.
