【摘要】：蒙古人的矛盾性格在其習(xí)俗與法律中體現(xiàn)為內(nèi)外有別的二元犯罪觀與相對寬和的刑罰文化。當(dāng)時的蒙古各部落內(nèi)部因"約孫"的調(diào)整而相對穩(wěn)定,卻因為部落間的仇恨和爭奪而連年混戰(zhàn),與其二元犯罪觀有關(guān)。蒙古人的刑罰從帝國前期的極端嚴(yán)苛發(fā)展到北元時期日益表現(xiàn)出的輕緩。這一變遷與蒙古王公貴族的治理術(shù)以及國家觀念的瓦解有很大的關(guān)聯(lián)。
[Abstract]:The contradictory character of the Mongols is embodied in their customs and laws as a dual view of crime and a relatively lenient penalty culture. At that time, the Mongolian tribes were relatively stable because of the adjustment of "Joson", but they fought for years because of hatred and contention between tribes, which was related to their dual view of crime. The penalty of Mongols developed from extreme severity in the early period of the empire to the light and gentle gradually in the Northern Yuan Dynasty. This change is closely related to the governance of the Mongol princes and the disintegration of the concept of state.
