談歷史上的容隱制度及其對現(xiàn)代刑法的影響

【摘要】:中國古代的容隱制度在很早的時(shí)候就有了,其萌芽可以追溯到西周時(shí)期制定的“親親”“尊尊”的周禮,以及春秋時(shí)期孔子“父為子隱,子為父隱,直在其中矣”的言論。從秦朝起到清朝末年我國封建制度解體,都一直保留了容隱制度,這表示我國的封建統(tǒng)治者在法律與親情相沖突時(shí)一直都在尋求一個(gè)平衡,對親情預(yù)留了更大的空間,按照身份的不同對同一罪行分別處罰,維護(hù)家庭的穩(wěn)定,維護(hù)社會(huì)秩序。到了民國的時(shí)候,我國已經(jīng)不是一個(gè)封建的國家了,西學(xué)東漸和現(xiàn)代法律制度的建立使得我國的法律有了很大的改變,但是容隱這一制度卻一直得以保留。臺(tái)灣刑法受民國時(shí)期刑法影響很大,所以在其現(xiàn)行刑法中也保留了容隱制度。 西方也有容隱制度,并且從古沿用至今,現(xiàn)代西方國家的刑法中也承認(rèn)這一制度。雖然東西方在文化、思想、觀點(diǎn)上有很多的不同之處,但是都產(chǎn)生了內(nèi)容相似的容隱制度,這說明了這種制度是符合全人類道德和情感期待的,是符合人性的制度。 我國現(xiàn)行刑法中沒有關(guān)于親屬容隱的規(guī)定,我認(rèn)為這種缺失是很讓人遺憾的。我國的法律中應(yīng)該引入容隱制度,承認(rèn)親情的分量,緩和“情”與“法”的沖突,構(gòu)建和諧社會(huì)。所以我搜集資料寫了本文。本文分為引言、四個(gè)章節(jié)和結(jié)論六個(gè)部分。 在引言中,我說明了寫作本文的緣起及論文的研究對象、文獻(xiàn)綜述及寫作背景、主旨、目的、意義。然后在正文中進(jìn)行具體介紹。第一章是容隱制度的歷史沿革,介紹了中國古代的容隱制度和西方古代的容隱制度,讓大家看到雖然東西方文化不同,但是都孕育出了親屬容隱這一符合人性的制度。 第二章是現(xiàn)代西方的容隱制度,通過按罪名分類的方式介紹了不同國家關(guān)于盜竊罪、侵占罪、詐騙罪、隱匿犯罪人罪、湮滅證據(jù)罪等與容隱有關(guān)的罪行是如何規(guī)定的,然后還介紹了一下臺(tái)灣的刑法中關(guān)于容隱制度的規(guī)定。 第三章是探討容隱制度是否應(yīng)該引入現(xiàn)行刑法中來,有的學(xué)者認(rèn)為容隱制度是一種封建糟粕,應(yīng)該被摒棄,不應(yīng)該引入刑法。但是有的學(xué)者認(rèn)為容隱制度是一種符合人性、符合期待可能性的制度,是維護(hù)人倫親情的制度,應(yīng)該引入現(xiàn)代刑法中來。我贊同后一種觀點(diǎn),認(rèn)為應(yīng)該在我國刑法中引入容隱制度。 第四章是關(guān)于如何在現(xiàn)行刑法中引入容隱制度的制度設(shè)計(jì)。我認(rèn)為我國可以把與容隱有關(guān)的罪名設(shè)定為親告罪;然后規(guī)定可容隱親屬的范圍:限于配偶、直系血親和同居共財(cái)?shù)挠H屬;再規(guī)定容隱制度的處罰是“可以減輕或免除處罰”,而不是規(guī)定“應(yīng)當(dāng)減輕或免除處罰”。因?yàn)楝F(xiàn)代社會(huì)注重對個(gè)人權(quán)利的保護(hù),人們覺醒了自由的意識(shí),不愿意被家庭、宗族等束縛,追求自由和自己權(quán)利的實(shí)現(xiàn),所以在具體案件中要區(qū)別對待。如果犯罪人的情節(jié)特別惡劣,或者被害人覺得不公正,不能容忍自己親屬的這種作為,還是應(yīng)該予以懲處,否則就不能保護(hù)個(gè)人的權(quán)利,損害了被害人的利益,將身份凌駕于個(gè)人權(quán)利之。這樣的行為是不符合現(xiàn)代刑法精神的。 最后得出結(jié)論:我國應(yīng)該在現(xiàn)行刑法中引入容隱制度,但是在引入的時(shí)候要小心,不能造成歷史的倒退。
[Abstract]:From Qin Dynasty to the end of Qing Dynasty , China ' s feudal rulers have been seeking a balance , reserving more space for the same crime , maintaining the stability of the family and maintaining the social order .


Western countries also have an implicit system , and from ancient times to now , the criminal law of modern western countries also recognized the system . Although East and West have many differences in culture , thought and point of view , it has produced a similar implicit system , which indicates that the system is in accordance with the human morality and the emotion expectation , and is a system that conforms to humanity .


In our country ' s current criminal law , there is no provision on the allowance of relatives , and I think this lack is very regrettable . The law of our country should introduce the tolerance system , recognize the component of the affection , relax the conflict between the " feelings " and the law , and build a harmonious society . So I have gathered the information to write this paper . This paper is divided into three parts : introduction , four chapters and conclusion .


In the introduction , I explained the origin of writing and the research object of the thesis , literature review and writing background , subject , purpose and significance . Chapter one is the historical evolution of the implicit system , introduces the implicit system in ancient China and the implicit system in ancient times , which makes it possible to see that while the East and West culture is different , it has raised the relative capacity of relatives to conceal the human nature .


The second chapter is the implicit system of modern west , and introduces the crime of crime of theft , crime of aggression , fraud , concealment of the crime of the crime , the crime of annihilation evidence and so on by the way of classification according to the crime , then introduces the provisions of the criminal law of Taiwan concerning the implicit system .


The third chapter is to discuss whether the implicit system should be introduced into the existing criminal law . Some scholars think that the implicit system is a feudal dross , should be rejected and should not be introduced into the criminal law . But some scholars think that the implicit system is a system which accords with the human nature and is in conformity with the expectation possibility . It is the system of maintaining the affection of the human being . I agree with the latter point of view that we should introduce the tolerance system in the criminal law of our country .


The fourth chapter is about how to introduce the system design of the implicit system in the current criminal law . I think that our country can set aside the charges related to it as a crime ; and then the scope of the implicit relatives is limited to the spouse , lineal relatives and relatives of the same person ;


Finally , it comes to the conclusion that our country should introduce the implicit system in the current criminal law , but be careful not to cause the retrogression of history when it is introduced .
