【摘要】:學(xué)術(shù)自由是一個(gè)國家與民族學(xué)術(shù)研究得以發(fā)展與創(chuàng)新的重要保障,也是推動(dòng)社會(huì)持續(xù)前進(jìn)、社會(huì)文化得以傳承及發(fā)揚(yáng)的持久動(dòng)力。因此,不管是從整個(gè)國家與民族的命運(yùn)考慮,還是從每個(gè)國民的切身利益考慮,都應(yīng)該保障學(xué)術(shù)自由使其不受妨礙。同時(shí),學(xué)術(shù)自由作為各國大學(xué)發(fā)展之重要條件以及高等教育之關(guān)鍵內(nèi)容,對其的研究及保護(hù)越來越受到國內(nèi)外學(xué)者的重視。日本可以說是亞洲國家中,最早受到德國、美國的影響,而產(chǎn)生學(xué)術(shù)自由觀念并形成大學(xué)自治的國家。且在歷史上也有著豐富的為爭取學(xué)術(shù)自由及大學(xué)自治而奮斗的事例,并形成了十分豐富龐雜的判例、學(xué)說與研究成果。因此,本文將以歷史發(fā)展之脈絡(luò)為主線針對日本學(xué)問自由憲法保障的現(xiàn)狀進(jìn)行研究與分析,力圖能夠全面深入地剖析出日本學(xué)問自由保障方式以及憲法在其中的作用。本文共計(jì)分為五大部分:第一部分是引言,簡單介紹本文的研究意義、研究現(xiàn)狀、研究方法以及創(chuàng)新之處。第二部分是日本學(xué)問自由入憲的社會(huì)背景。主要是介紹學(xué)問自由在日本憲法中的產(chǎn)生、演變的過程,并分析其社會(huì)基礎(chǔ)以及思想、理論基礎(chǔ)。第三部分是日本學(xué)問自由的構(gòu)成要件。重點(diǎn)分析了日本學(xué)問自由有關(guān)的基礎(chǔ)性概念。具體包括學(xué)問的涵義、學(xué)問自由的內(nèi)容、學(xué)問自由的主體、學(xué)問自由的限制四方面內(nèi)容。第四部分是日本學(xué)問自由的制度保障。該部分內(nèi)容主要分析了作為日本慣行的大學(xué)自治對學(xué)問自由的保障,不僅包括日本傳統(tǒng)的大學(xué)自治制度其中也介紹了日本法人化改革后對學(xué)問自由保障的影響。具體包括大學(xué)管理運(yùn)營體制、人事制度保障、財(cái)政制度保障三方面內(nèi)容。第五部分是日本學(xué)問自由的憲法救濟(jì)。本部分主要從大學(xué)自治之救濟(jì)、下級(jí)教育機(jī)關(guān)教育自由之救濟(jì)、學(xué)生學(xué)習(xí)自由之救濟(jì)三方面所涉及的具體判例來介紹與分析。
[Abstract]:Academic freedom is not only an important guarantee for the development and innovation of academic research in a country and a nation, but also a lasting driving force to promote the continuous progress of society and the inheritance and development of social culture. Therefore, academic freedom should be guaranteed from the fate of the whole nation and nation, and from the vital interests of every nation. At the same time, academic freedom, as an important condition for the development of universities and the key content of higher education, has been paid more and more attention to by scholars at home and abroad. Japan can be said to be the first country in Asia to be influenced by Germany and the United States, and to form the concept of academic freedom and university autonomy. There are also abundant examples of striving for academic freedom and university autonomy in history, and have formed very rich and complicated cases, theories and research results. Therefore, this article will take the historical development thread as the main line to carry on the research and the analysis to the Japanese freedom of learning constitutional guarantee present situation, tries to be able to comprehensively and deeply analyzes the Japanese academic freedom safeguard way and the constitution in which the function. This paper is divided into five parts: the first part is the introduction, briefly introduces the significance of this study, research status, research methods and innovations. The second part is the social background of the free entry of Japanese learning into the constitution. It mainly introduces the process of the birth and evolution of the freedom of learning in the Japanese Constitution, and analyzes its social basis, thought and theoretical basis. The third part is the constituent elements of Japanese freedom of learning. The basic concepts related to the freedom of learning in Japan are emphatically analyzed. It includes the meaning of learning, the content of freedom of learning, the subject of freedom of learning and the restriction of freedom of learning. The fourth part is the system guarantee of Japanese freedom of learning. This part mainly analyzes the guarantee of university autonomy to the freedom of learning, which includes not only the traditional university autonomy system in Japan, but also the influence of Japanese legalization reform on the guarantee of the freedom of learning. It includes three aspects: university management system, personnel system guarantee and financial system guarantee. The fifth part is the constitutional relief of Japanese freedom of learning. This part mainly introduces and analyzes the specific cases involved in the relief of university autonomy, the relief of educational freedom of lower educational institutions and the relief of students' freedom of study.
