【摘要】：2014年3月至5月,美國專利商標(biāo)局組織召開了兩輪多邊利益攸關(guān)方對話,推動(dòng)互聯(lián)網(wǎng)產(chǎn)業(yè)與版權(quán)內(nèi)容產(chǎn)業(yè)就如何改進(jìn)美國數(shù)字千年版權(quán)法(DMCA)中的通知—移除程序之最佳實(shí)踐進(jìn)行交流探討,并確立了在2014年底前建立更加高效、可靠的通知—移除實(shí)踐的政策目標(biāo)。美國在完善通知—移除實(shí)踐方面的探索,是在互聯(lián)網(wǎng)技術(shù)飛速發(fā)展的時(shí)代背景下,為更好地遏制盜版內(nèi)容在網(wǎng)絡(luò)中傳播邁出的重要一步,對我國審視、完善自身的避風(fēng)港規(guī)則有借鑒意義。
[Abstract]:From March 2014 to May, the United States Patent and Trademark Office organized two rounds of multilateral stakeholder dialogues to promote the exchange of Internet industries and copyright content industries on how to improve the best practices of notification removal procedures in the DMCA, and establish a more efficient and reliable approach by the end of 2014. The goal of understanding and removing the practice is to explore the perfect notification and removal practice in the United States. It is an important step to better curb the spread of pirated content in the network in the background of the rapid development of Internet technology. It has a reference to our country to examine and improve the rules of its own safe haven.
