基于公共人力資源管理視角的重慶市法治專門人才隊伍建設(shè)研究

【摘要】:政法機關(guān)是國家行政部門,也是重要的執(zhí)法機關(guān),是我國的窗口單位,代表著黨和國家履行職責,直接同廣大人民群眾直接接觸,充當著黨和政府聯(lián)系人民群眾的橋梁以及紐帶。在十八屆四中全會上,《中共中央關(guān)于全面推進依法治國若干重大問題的決定》的通過,首次把一支高素質(zhì)的法治工作隊伍同我國“依法治國”的總目標緊密聯(lián)系了起來,明確了全面推進我國依法治國的進程就必須大力提高法治工作隊伍的思想政治素質(zhì)、業(yè)務(wù)能力素質(zhì)、職業(yè)道德素質(zhì),并首次提出了法治專門隊伍、法律服務(wù)隊伍、法學(xué)教學(xué)和研究隊伍這三個概念。之所以提出“法治專門人才隊伍”這個概念,就是要實現(xiàn)人才強法,人才強法作為人才強國的重要組成部分,在我國全面推進依法治國進程中有重大的意義。在法治工作隊伍當中,法治專門人才隊伍很明顯是生力軍,它包括立法、執(zhí)法、司法三類重要作用,立法人員為國家定規(guī)矩、為社會定方圓;執(zhí)法人員必須忠誠于法律、捍衛(wèi)法律、嚴格執(zhí)法、勇于擔當;司法人員必須信仰法律、堅守法治、鐵面無私、秉公執(zhí)法。在本研究當中,首先進行了大量國內(nèi)國外關(guān)于法治專門人才隊伍建設(shè)研究的文獻分析和梳理,并針對到底什么是高素質(zhì)的法治專門人才隊伍進行了專家咨詢,得到了一個高素質(zhì)法治專門人才隊伍的標準,主要是從思想政治素質(zhì)、業(yè)務(wù)能力素質(zhì)、職業(yè)道德素質(zhì)這三方面進行的歸類。再次,針對重慶市的法治專門人才隊伍,本研究進行了問卷的發(fā)放和開展了調(diào)研訪談工作,旨在錨定重慶市法治專門人才隊伍現(xiàn)階段建設(shè)過程當中的問題,向在職的1500余名法治專門人才進行了問卷的發(fā)放,邀請他們參與、支持本研究,最后,根據(jù)問卷調(diào)查、訪談?wù){(diào)研的反饋情況,本研究系統(tǒng)地從思想政治素質(zhì)、業(yè)務(wù)能力素質(zhì)、職業(yè)道德素質(zhì)三個方面提出了當前重慶市法治專門人才隊伍存在的問題并根據(jù)公共人力資源管理視角,從選拔機制、考評機制、培訓(xùn)機制、激勵機制四個方面對問題的原因進行了較為詳細的分析和說明,最后根據(jù)問卷調(diào)查、訪談?wù){(diào)研以及專家咨詢,本研究從“入口關(guān)”、“培訓(xùn)關(guān)”、“激勵關(guān)”、“監(jiān)督關(guān)”四個方面提出了建設(shè)高素質(zhì)重慶市法治專門人才隊伍的對策和建議。
[Abstract]:The political and legal organs are the administrative departments of the state, as well as important law enforcement agencies. They are the window units of our country. They represent the Party and the state in performing their duties and in direct contact with the broad masses of the people. It acts as a bridge and tie between the Party and the government to connect the people. At the fourth Plenary session of the 18th CPC Central Committee, the adoption of the "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" for the first time closely linked a high-quality contingent of rule of law work with the general goal of "ruling the country according to law". It is clear that it is necessary to improve the ideological and political quality, professional ability quality, professional ethics quality of the work force of rule of law in order to advance the process of ruling the country according to law in an all-round way, and put forward for the first time the specialized contingent of rule of law and the team of legal service. The three concepts of law teaching and research team. The reason why we put forward the concept of "specialized talents under the rule of law" is that it is necessary to enforce the law by talents. As an important part of the powerful country of talents, it is of great significance in the process of promoting the rule of law in an all-round way in our country. In the work team of the rule of law, the contingent of specialized talents on the rule of law is obviously a fresh force. It includes three important roles: legislation, law enforcement, and justice. Legislators set the rules for the country and the society as a whole. Law enforcement personnel must be loyal to the law. Defend the law, strictly enforce the law, be responsible; the judiciary must believe in the law, adhere to the rule of law, selfless, impartial law enforcement. In this study, first of all, a large number of domestic and foreign research on the construction of specialized talents in the rule of law literature analysis and combing, and in the end what is the high quality of the rule of law specialized talent team for expert consultation, This paper obtains the standard of a contingent of high quality specialized talents of rule of law, which is classified mainly from three aspects: ideological and political quality, professional ability quality and professional ethics quality. Thirdly, according to Chongqing rule of law professionals, this study carried out questionnaires and interviews, in order to anchor the current construction of Chongqing rule of law professionals in the process of problems, The questionnaire was distributed to more than 1500 legal professionals on the job, and they were invited to participate in the study to support the research. Finally, according to the feedback from the questionnaire survey and interview, the research systematically from the ideological and political quality, professional ability quality, Three aspects of professional ethics quality put forward the existing problems of Chongqing rule of law specialized talents team, and according to the perspective of public human resources management, from the selection mechanism, evaluation mechanism, training mechanism, Four aspects of incentive mechanism are analyzed and explained in detail. Finally, according to questionnaire, interview and expert consultation, this study is from "entrance pass", "training pass", "incentive pass". Four aspects of "supervision and clearance" put forward the countermeasures and suggestions for the construction of high-quality Chongqing rule of law professionals.
