【摘要】：數(shù)字藝術(shù)是一種基于人工智能技術(shù)創(chuàng)生的新型藝術(shù)形態(tài),其本質(zhì)在于雙重互動(dòng)不確定性機(jī)制。在該機(jī)制的作用下,數(shù)字藝術(shù)行為秩序較之原子藝術(shù)行為秩序發(fā)生了重大而深遠(yuǎn)的變化。首先,數(shù)字藝術(shù)開(kāi)拓出一種人人享有的創(chuàng)作權(quán)和傳播權(quán),消解了原子藝術(shù)秩序中的藝術(shù)創(chuàng)作特權(quán)和傳播特權(quán),數(shù)字藝術(shù)創(chuàng)作權(quán)利的本質(zhì)是一種藝術(shù)發(fā)表權(quán)。其次,通過(guò)藝術(shù)發(fā)表權(quán),數(shù)字藝術(shù)衍生出一種原子藝術(shù)秩序沒(méi)有的藝術(shù)接觸權(quán),接觸權(quán)也是一種普遍的、平等的、人人共享的藝術(shù)權(quán)利。另外,數(shù)字藝術(shù)還抑制了主權(quán)者的藝術(shù)監(jiān)管權(quán)力。數(shù)字藝術(shù)上述擴(kuò)大的權(quán)利也相應(yīng)為數(shù)字藝術(shù)主體衍生出同等數(shù)量的藝術(shù)義務(wù)。相對(duì)于原子藝術(shù)秩序中的那些義務(wù),數(shù)字藝術(shù)義務(wù)的履行即尊重各項(xiàng)數(shù)字藝術(shù)權(quán)利的行使、避免生產(chǎn)傳播有損于社會(huì)大眾身心健康的藝術(shù)作品在當(dāng)下人工智能社會(huì)遭遇到了巨大的挑戰(zhàn)。
[Abstract]:Digital art is a new art form based on artificial intelligence technology, and its essence lies in the mechanism of double interaction uncertainty. Under the action of this mechanism, the order of digital art acts has undergone great and profound changes compared with the order of atomic art acts. First of all, digital art exploits a kind of creation right and dissemination right that everyone enjoys, dissolves the artistic creation privilege and dissemination privilege in atomic art order, the essence of digital art creation right is a kind of art publishing right. Secondly, through the right of art publication, digital art gives rise to a kind of art contact right which the atomic art order does not have, and the right of contact is also a universal, equal and shared art right. In addition, digital art also suppresses the sovereign's artistic regulatory power. The expanded rights of digital art are corresponding to the equal number of artistic obligations derived from the subject of digital art. In contrast to those obligations in the atomic art order, the fulfilment of the obligation of digital art is to respect the exercise of the rights of digital art, Avoiding the production and dissemination of works of art that are harmful to the physical and mental health of the general public has encountered great challenges in the present artificial intelligence society.
