【摘要】：清代官文書稽程制度是清代法律期間制度,是清代行政系統(tǒng)、司法系統(tǒng)的有機組成部分,對維護清朝封建國家的正常運轉(zhuǎn)發(fā)揮了重要的作用。通過對該制度的研究,一方面可以更好的了解清代的法律制度與法律體系,特別是期間制度的相關(guān)內(nèi)容,以及該制度在保障清代的司法機關(guān)的有效運轉(zhuǎn)和提高司法效率的重要作用,加深對清代期間制度和吏治的認識；另一方面可以通過對清代官文書稽程制度的制定、內(nèi)容、實施等各方面的研究,取其中的精華,為我國期間制度設(shè)計和社會主義法制建設(shè)提供有益借鑒。 本文從清代法律典籍入手,通過對文獻的研究和比較,以及對案例的分析等方法,從四個方面考察清代官文書稽程制度的主要內(nèi)容,對該制度進行系統(tǒng)分析總結(jié)。 第一部分為清代官文書稽程制度的形成。主要論述了官文書稽程制度的含義,清代官文書稽程制度的制度淵源以及其發(fā)展。 第二部分主要考察清代官文書稽程制度的具體程限規(guī)定。這一部分主要從《大清律例》入手,分類總結(jié)分析清代官文書稽程制度中針對不同情形下具體程限之規(guī)定。 第三部分主要分析清代官文書稽程之法律責任。主要從處罰方式和主體責任分擔方式兩方面著手加以明確。 第四部分是對清代官文書稽程制度的分析與評價。主要從該制度司法運行實踐分析,對該制度的具體內(nèi)容和體系加以分析,在參酌了清代著名法學(xué)家薛允升的觀點的基礎(chǔ)上對該制度加以評價,指出其不足之處和可供借鑒之處。
[Abstract]:The system of checking official documents in Qing Dynasty is the legal period system of Qing Dynasty. It is an organic part of the administrative system and judicial system of Qing Dynasty. It plays an important role in maintaining the normal operation of feudal country in Qing Dynasty. Through the study of this system, on the one hand, we can better understand the legal system and legal system of the Qing Dynasty, especially the relevant contents of the system during the period. The system plays an important role in ensuring the effective operation of the judicial organs in the Qing Dynasty and improving the judicial efficiency, deepening the understanding of the system and the official administration during the Qing Dynasty; on the other hand, the establishment and content of the official document checking system of the Qing Dynasty can be adopted. The research in various aspects, such as implementation, takes the essence of it and provides useful reference for the system design and the construction of socialist legal system during the period of our country. This paper begins with the legal books of Qing Dynasty, through the research and comparison of the literature, and the analysis of cases, from four aspects to investigate the main contents of the system of official documents in the Qing Dynasty, and make a systematic analysis and summary of the system. The first part is the formation of the system of checking official documents in Qing Dynasty. This paper mainly discusses the meaning of official document checking system, the system origin and its development of official document checking system in Qing Dynasty. The second part mainly examines the Qing Dynasty official document check system specific program limit stipulation. This part mainly starts with "Qing laws and regulations", classifies and analyzes the provisions of the system of checking official documents in the Qing Dynasty under different circumstances. The third part mainly analyzes the legal liability of Cheng Zhi. Mainly from the punishment way and the main body responsibility sharing way two aspects to proceed to be clear. The fourth part is the analysis and evaluation of the system of checking official documents in Qing Dynasty. Based on the analysis of the judicial practice of the system, the concrete content and system of the system are analyzed, and on the basis of the views of Xue Yunsheng, a famous jurist in the Qing Dynasty, the author evaluates the system, and points out its shortcomings and the points for reference.
