【摘要】：作為舉世矚目的世紀(jì)工程,三峽工程的成敗不僅在于大壩本身,更在于110多萬庫區(qū)移民如何能夠“搬得出、安得穩(wěn)、逐步能致富”。要實現(xiàn)這一目標(biāo),必須在目前進(jìn)行的庫區(qū)后期扶持工作中建立起對移民權(quán)益的法律保障制度,以回應(yīng)三峽工程“開發(fā)性移民”的方針和依法開展移民工作的要求。作為三峽庫區(qū)移民中的農(nóng)村移民,由于其生產(chǎn)、生活受到的影響更大,遷后重建更加困難,表達(dá)利益訴求的渠道更加不暢,屬于移民中的弱勢群體,因而更加需要關(guān)注與重視。由此,需特別著眼于對農(nóng)村移民的法律保障,構(gòu)造相輔相成系統(tǒng)聯(lián)動的制度體系,以捍衛(wèi)其權(quán)益。 針對這一問題,筆者立足農(nóng)村移民權(quán)益現(xiàn)狀,在總結(jié)國內(nèi)外工程性移民權(quán)益保護(hù)經(jīng)驗教訓(xùn)的基礎(chǔ)上,對三峽工程后期扶持中農(nóng)村移民權(quán)益法律保護(hù)的制度建設(shè)進(jìn)行了系統(tǒng)性、探索性的研究,主要包括以下三大部分: 第一部分:三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益保護(hù)的基本問題。筆者首先界定了三峽庫區(qū)、三峽庫區(qū)移民、農(nóng)村移民以及三峽庫區(qū)后期扶持中的農(nóng)村移民權(quán)益幾個概念,并明確了三峽庫區(qū)后期扶持中的農(nóng)村移民權(quán)益保護(hù)之權(quán)利基礎(chǔ),即農(nóng)村移民的生存權(quán)、發(fā)展權(quán)、知情權(quán)、參與權(quán)和監(jiān)督權(quán)。接下來,筆者從微觀視角和宏觀視角兩方面出發(fā),闡述了三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益保護(hù)的理論基礎(chǔ),即人權(quán)、公民權(quán)、社會發(fā)展與社會穩(wěn)定。最后,筆者提出了三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益保護(hù)的應(yīng)然狀態(tài),包括確立農(nóng)村移民的主體地位,進(jìn)行全方位的權(quán)益保護(hù),以生存權(quán)、發(fā)展權(quán)、知情權(quán)、參與權(quán)、監(jiān)督權(quán)的保護(hù)為著眼點以及構(gòu)建有效的決策參與、利益表達(dá)、利益協(xié)調(diào)和利益救濟(jì)機(jī)制。 第二部分:三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益保護(hù)的現(xiàn)狀。首先,結(jié)合實證調(diào)查,考察了三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益受損的表現(xiàn),包括后期扶持需應(yīng)對的權(quán)益受損的狀況和后期扶持中產(chǎn)生的權(quán)益受損的狀況兩個層面。然后,筆者從農(nóng)村移民生存權(quán)、發(fā)展權(quán)、知情權(quán)、參與權(quán)、監(jiān)督權(quán)幾個方面,對三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益保護(hù)的政策與法制作出了系統(tǒng)評估,明確了其中的缺陷。 第三部分:三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益法律保障制度的構(gòu)造。在制度構(gòu)造的過程中,筆者運用文獻(xiàn)分析和比較分析的研究方法,立足國內(nèi)外工程性移民權(quán)益保護(hù)工作的經(jīng)驗教訓(xùn),提出了三峽庫區(qū)后期扶持中農(nóng)村移民權(quán)益法律保障制度的基本理念和主要制度。對于基本原則的確立,筆者從經(jīng)濟(jì)法的視角出發(fā),提出了社會本位、有限政府兩大原則;另外,基本原則還包括依法后扶以及保障性與發(fā)展性并重。在主要制度的構(gòu)建中,筆者提出了要著重建立以下幾種制度,即后扶資金投入與管理制度、農(nóng)村移民社會保障制度、農(nóng)村移民培訓(xùn)與就業(yè)促進(jìn)制度、農(nóng)村移民項目扶持制度、農(nóng)村移民參與、監(jiān)督制度以及農(nóng)村移民權(quán)益救濟(jì)與法律援助制度。
[Abstract]:As the world-famous century project, the success or failure of the Three Gorges project lies not only in the dam itself, but also on how the immigrants in the 110 million reservoir area can "move to, get stable and get rich gradually". To achieve this goal, the legal guarantee system for the rights and interests of immigrants must be established in the support of the late period of the reservoir area to respond to the Three Gorges Project. As the rural emigrants in the Three Gorges Reservoir area, the rural emigrants in the Three Gorges Reservoir area are more affected by their production, more difficult to relocate, and the channels for expressing the interests of the migrants are more difficult, and they belong to the disadvantaged groups in the immigrants. Therefore, it is necessary to pay more attention and attention. Special attention should be paid to the legal protection of rural migrants, and a system of complementary and systematic linkage should be constructed to safeguard their rights and interests.
In view of this problem, based on the status of rural migrants' rights and interests, on the basis of summarizing the experience and lessons of protecting the rights and interests of migrant workers at home and abroad, the author makes systematic and exploratory research on the legal protection of the rights and interests of rural emigrants in the later stage of the Three Gorges project, which mainly includes the following three parts:
The first part: the basic problems of the protection of the rights and interests of the rural emigrants in the later stage of the Three Gorges Reservoir area. First, the author defines several concepts of the Three Gorges Reservoir area, the Three Gorges Reservoir area immigrants, the rural emigrants and the later support of the Three Gorges Reservoir Area, and clarifies the rights basis of the protection of the rural migrants in the later stage of the Three Gorges Reservoir area. The right to subsistence, the right to development, the right to know, the right to participate and the right to supervise the rural migrants. Then, from the two aspects of the micro and macro perspectives, the author expounds the theoretical basis for the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges Reservoir area, namely, human rights, civil rights, social development and social stability. Finally, the author puts forward the support of the Three Gorges Reservoir Area in the late period. The protection of the rights and interests of the rural emigrants, including the establishment of the main status of the rural migrants, and the full protection of rights and interests, with the right to survival, the right to development, the right to know, the right to participate, the protection of the right to supervision, and the construction of effective decision-making participation, interest expression, benefit coordination and benefit relief mechanism.
The second part: the status quo of the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges Reservoir area. First, the performance of the damage of the rights and interests of the rural migrants in the late support of the Three Gorges Reservoir area is examined by an empirical investigation, including the two levels of the damage to the rights and interests of the late support and the damage of the rights and interests produced in the later support. Then, the author The rural emigrants' right to survive, the right to development, the right to know, the right to participate, and the power of supervision, make a systematic assessment of the policy and legal system of the protection of the rights and interests of the rural migrants in the late stage of the Three Gorges reservoir.
The third part: the construction of the legal guarantee system for the rights and interests of the rural migrants in the later period of the Three Gorges Reservoir area. In the process of the system construction, the author uses the research methods of literature analysis and comparative analysis, and based on the experience and lessons of the protection work of the engineering emigrant rights at home and abroad, and puts forward the legal protection of the rights and interests of the rural migrants in the late support of the Three Gorge Reservoir area. The basic principle of the system and the main system. On the basis of the basic principles, the author, from the perspective of economic law, puts forward two principles of social standard and limited government. In addition, the basic principles include the legal support of the law and the balance between the security and the development. In the construction of the main system, the author puts forward to establish the following several systems, That is, capital investment and management system, rural emigration social security system, rural emigrant training and employment promotion system, rural emigrant project support system, rural emigrant participation, supervision system and rural emigrant rights and interests relief and legal aid system.
