【摘要】：憲法與革命,從規(guī)范主義的視角,從理想主義的目標來看,它們是完全對峙的。但是憲法離不開革命,革命制憲是現(xiàn)代性的政治本色,現(xiàn)代憲法都是經(jīng)由革命孕育和塑造出來的。在英國革命的起點確立之后,是不是能夠開辟出一個走向政治規(guī)范、走向立憲政府的規(guī)范之路,抵御從革命到激進革命的緊張狀態(tài),約束革命人民可以隨時革命的決斷權(quán),需要妥協(xié)制憲,這是英國光榮革命給予人類政治的一份最偉大的憲制經(jīng)驗�，F(xiàn)代性肯定要經(jīng)歷革命,但是這個妥協(xié)制憲能夠圓滿終結(jié)革命,這本來就是憲法的最大訴求。妥協(xié)向來是立憲政治的基本原則,英國立憲主義在保留革命精神的同時,也汲取了英倫政治傳統(tǒng)里崇尚調(diào)和、寬容、妥協(xié)的精神,一部英國光榮革命的歷史,實際上就是一部英國政治從激烈斗爭到相互妥協(xié)的憲制史。
[Abstract]:Constitution and revolution, from the perspective of normalism and idealism, they are completely confrontational. But the constitution is inseparable from the revolution, the revolutionary constitution is the political essence of modernity, and the modern constitution is nurtured and shaped by revolution. After the establishment of the starting point of the British revolution, could it be possible to open up a normative road towards political norms, towards a constitutional government, to resist the tension from revolution to radical revolution, and to constrain the revolutionary people's right to make decisions about revolution at any time? The need to compromise constitution is one of Britain's greatest constitutional experiences in human politics given by the glorious revolution. Modernity is bound to undergo a revolution, but this compromise constitution can bring the revolution to a successful end, which is the Constitution's greatest appeal. Compromise has always been the basic principle of constitutional politics. While British constitutionalism retains the revolutionary spirit, it also draws on the spirit of harmony, tolerance and compromise in the British political tradition, a history of Britain's glorious revolution. In fact, it is a constitutional history of British politics from fierce struggle to mutual compromise.
