【摘要】：英國(guó)的監(jiān)察專員主要包括公共監(jiān)察專員、私部門監(jiān)察專員和混合監(jiān)察專員等類型。公共監(jiān)察專員在充分運(yùn)用調(diào)查權(quán)和建議權(quán)的基礎(chǔ)上,不僅有效的實(shí)現(xiàn)了對(duì)行政機(jī)關(guān)不當(dāng)行政行為的監(jiān)督,還在實(shí)踐中不斷發(fā)展了"善政"的基本原則。私部門監(jiān)察專員和混合監(jiān)察專員在政府改革、司法改革及歐盟ADR指令的背景之下,逐漸成為解決消費(fèi)者糾紛的主體。監(jiān)察專員對(duì)英國(guó)善政、廉政和勤政的推進(jìn)、人權(quán)的保障、法治的維護(hù)等方面發(fā)揮了重要作用。這種制度安排對(duì)于中國(guó)監(jiān)察制度改革在角色定位、功能配置和組織架構(gòu)等方面均具啟示意義。
[Abstract]:Britain's ombudsmen mainly include public ombudsmen, private sector ombudsmen and mixed ombudsmen. On the basis of making full use of the right of investigation and advice, the public inspector not only effectively realizes the supervision of improper administrative behavior of administrative organs, but also develops the basic principle of "good governance" in practice. Under the background of government reform, judicial reform and EU ADR directive, private sector inspectors and mixed inspectors have gradually become the main body of resolving consumer disputes. The Ombudsman has played an important role in good governance, integrity and diligence, protection of human rights and the maintenance of the rule of law. This kind of system arrangement has enlightening significance to the reform of China's supervisory system in the aspects of role orientation, function allocation and organization structure.
