【摘要】：馬克思以其社會理論為認(rèn)知基礎(chǔ),將法律納入社會發(fā)展進(jìn)程中來考察:首先探討人類社會發(fā)展進(jìn)程中不同生產(chǎn)力水平上的生產(chǎn)關(guān)系與法律制度、法律體系之間的變動歷史,找尋法律發(fā)展的歷史規(guī)律;然后以其社會發(fā)展"三形態(tài)理論"為分析框架,通過對普魯士法律的深刻剖析,探討法律的評價(jià)標(biāo)準(zhǔn)和本質(zhì)。馬克思指出,衡量"真正的法律"的客觀標(biāo)準(zhǔn)只能是"人的行為本身",以此為準(zhǔn)則來探析并揭示法律的正面本質(zhì)只能是普遍平等的自由,法律的反面本質(zhì)必須是普遍平等的懲罰。因?yàn)檎嬲w現(xiàn)社會發(fā)展并為其提供規(guī)范和保障的"法律應(yīng)該以社會為基礎(chǔ)"并必然體現(xiàn)"成熟了的社會共同利益",這"是人的行為本身必備的規(guī)律",更是"人的生活的自覺反映"。
[Abstract]:Marx took his social theory as the cognitive basis, put the law into the process of social development to investigate: first of all, to explore the process of human social development on the different levels of productive forces in the production relations and legal system, the history of changes between the legal system, Based on the theory of "three forms" of social development, this paper explores the evaluation standard and essence of law through the deep analysis of Prussian law. Marx pointed out that the objective criterion of "real law" can only be "human behavior itself", which is used as a criterion to analyze and reveal that the positive nature of law can only be the freedom of universal equality. The opposite nature of the law must be universal and equal punishment. Because the "law should be based on the society" and must embody "the common interests of the mature society", which truly embodies the social development and provides the norm and guarantee for it, this is "the essential law of human's behavior", it is also "the human's" The conscious reflection of life.
