【摘要】：在清朝政府形成的過(guò)程中,清政府對(duì)包括土默特地區(qū)在內(nèi)的蒙古地區(qū)漠南蒙古和漠北蒙古各自實(shí)施不同行政管理模式的同時(shí),針對(duì)蒙古地區(qū)制定《蒙古律例》,以期國(guó)家法在蒙古地區(qū)能夠順利實(shí)施。然而,因法的制定與法的實(shí)施之間不能同步的緣故,國(guó)家法在蒙古地區(qū)實(shí)施的過(guò)程,必然顯現(xiàn)出或遇阻力、或變通執(zhí)行、或經(jīng)歷與少數(shù)民族習(xí)慣法之間的博弈過(guò)程,或等待包括當(dāng)?shù)厮痉ü僭趦?nèi)的民眾的熟悉適用國(guó)家法的轉(zhuǎn)變。土默特蒙古文檔案記載的臺(tái)吉(蒙古族貴族)偷竊大畜案所涉若干司法審判問(wèn)題,在一定程度上反映了《蒙古律例》作為國(guó)家法在當(dāng)時(shí)的歸化城土默特地區(qū)以及蒙古地區(qū)的實(shí)施情況。
[Abstract]:In the process of the formation of the Qing government, the Qing government implemented different administrative modes on the Mongolia region, including the Tumert region, in the desert south Mongolia and the desert north Mongolia respectively. In order to ensure the smooth implementation of the national law in Mongolia region, this paper formulates Mongolian laws and regulations. However, due to the lack of synchronization between the enactment of the law and the implementation of the law, the process of the implementation of the national law in Mongolia is bound to show resistance, or alternative implementation, or experience a game process with the customary law of the minority nationalities. Or wait for the people, including local magistrates, to become familiar with the change in the application of national law. A number of judicial issues related to the theft of large livestock by Taiji (Mongol aristocracy) recorded in the Tumert Mongolian file, To a certain extent, it reflects the implementation of the Mongolian Law as the national law in Tumert, the naturalized city at that time, as well as in Mongolia.
