【摘要】：從2001年的《愛(ài)國(guó)者法案》到2015年的《自由法案》,美國(guó)的反恐立法發(fā)生了從強(qiáng)調(diào)擴(kuò)大政府權(quán)力以有效打擊恐怖活動(dòng)向兼顧保護(hù)公民憲法權(quán)利的轉(zhuǎn)變,對(duì)于反恐模式與訴訟程序、執(zhí)法機(jī)關(guān)在國(guó)內(nèi)搜集情報(bào)的特別權(quán)力與手段以及不斷擴(kuò)大電子監(jiān)控范圍的做法,立法者和法官也從最初的附條件支持、默認(rèn),到警覺(jué)和限制。美國(guó)反恐法律實(shí)踐給予我國(guó)的啟示是,任何反恐立法都要以尋求政府權(quán)力與公民權(quán)利之間的平衡為指導(dǎo)原則;政府權(quán)力的授予要由法律明確界定;法律內(nèi)容應(yīng)隨著反恐實(shí)際情況的變化適時(shí)調(diào)整;司法機(jī)關(guān)要切實(shí)履行監(jiān)督執(zhí)法部門(mén)、保護(hù)公民權(quán)利的職責(zé)。
[Abstract]:From the Patriot Act of 2001 to the Freedom Act of 2015, the anti-terrorism legislation in the United States has changed from emphasizing the expansion of government power to effectively combating terrorist activities to taking into account the protection of citizens' constitutional rights. The special powers and tools of law enforcement agencies to gather intelligence at home and the practice of expanding the scope of electronic surveillance, legislators and judges also from the initial conditional support, acquiescence, to vigilance and restrictions. The enlightenment of American anti-terrorism legal practice is that any anti-terrorism legislation should be guided by seeking the balance between government power and civil rights, and the conferment of government power should be clearly defined by law. The content of the law should be adjusted with the change of the actual situation of anti-terrorism, and the judicial organ should carry out the duty of supervising the law enforcement department and protecting the citizen's rights.
