【摘要】：黨的十八屆四中全會(huì)通過了全面推進(jìn)依法治國,加快建設(shè)社會(huì)主義法治國家的綱領(lǐng)性文獻(xiàn)——《中共中央關(guān)于全面推進(jìn)依法治國若干重大問題的決定》,這是我黨在執(zhí)政歷史上第一次以全面推進(jìn)依法治國為主題而作出的全面部署,開啟了法治中國新時(shí)代。習(xí)近平總書記在堅(jiān)持和發(fā)展中國特色社會(huì)主義戰(zhàn)略布局的“四個(gè)全面”思想中強(qiáng)調(diào),要“全面推進(jìn)依法治國”。而彭真作為社會(huì)主義法制的主要奠基人,畢生關(guān)注新中國的法制建設(shè),在立法、守法、執(zhí)法、司法、權(quán)力監(jiān)督及將民主法律化等方面,為健全社會(huì)主義法制作出了卓越的貢獻(xiàn),其思想雖歷久而彌新。因此,在新的歷史條件下,研究彭真的法制思想,汲取其精髓來指導(dǎo)當(dāng)前我國法治建設(shè)的實(shí)踐,對于解決法治建設(shè)過程中出現(xiàn)的一些問題,具有非常重要的現(xiàn)實(shí)指導(dǎo)意義,也對協(xié)調(diào)推進(jìn)“四個(gè)全面”戰(zhàn)略布局、構(gòu)建社會(huì)主義和諧社會(huì)、實(shí)現(xiàn)中華民族偉大復(fù)興的“中國夢”,具有積極的參鑒價(jià)值。全文共分為四個(gè)部分:第一部分為緒論。該部分主要論述了論文的“選題緣由及研究意義”、“彭真法制思想的研究現(xiàn)狀”、“本課題的研究思路和研究方法”、“本課題的預(yù)期目標(biāo)、創(chuàng)新點(diǎn)和不足之處”。通過論述,闡明了論文的選題背景、目的及意義,從學(xué)術(shù)專著和學(xué)術(shù)論文兩個(gè)層面分析了彭真法制思想的研究現(xiàn)狀,明確了論文的研究思路和方法,明晰了論文的預(yù)期目標(biāo)、創(chuàng)新點(diǎn)和不足之處;第二部分論述了“彭真法制思想的內(nèi)涵及其形成的條件”。該部分在對彭真法制思想內(nèi)涵進(jìn)行總結(jié)歸納的同時(shí),認(rèn)為彭真法制思想形成的條件包括:客觀條件、主觀條件和理論條件。通過進(jìn)一步分析,認(rèn)為彭真法制思想形成的主觀條件包括:實(shí)踐條件和個(gè)人內(nèi)因條件;彭真法制思想形成的理論條件包括:“彭真對馬克思主義和列寧法制思想的繼承與發(fā)展”、“彭真對中國傳統(tǒng)法制思想的批判與繼承”以及“彭真對中國共產(chǎn)黨人法制思想的傳承與發(fā)展”;第三部分論述了“彭真法制思想的形成過程及其主要內(nèi)容”。該部分將彭真法制思想的形成過程分為產(chǎn)生階段、完善階段和成熟階段進(jìn)行闡釋,同時(shí),重點(diǎn)從立法、守法、執(zhí)法、司法、權(quán)力監(jiān)督和將民主法律化等方面對其法制思想的主要內(nèi)容加以分析和闡述;第四部分論述了“彭真法制思想的當(dāng)代價(jià)值”。該部分具體分析了彭真法制思想所蘊(yùn)含的“理論價(jià)值”和“實(shí)踐價(jià)值”。通過分析,筆者認(rèn)為,彭真法制思想的理論價(jià)值為:“促進(jìn)了馬克思主義法學(xué)理論的中國化”、“豐富和發(fā)展了社會(huì)主義法制建設(shè)理論”;同時(shí),結(jié)合我國當(dāng)前法治實(shí)踐的具體實(shí)際,認(rèn)為彭真法制思想的實(shí)踐價(jià)值為:“有助于健全社會(huì)主義法律體系”、“有助于促使法制觀念深入人心”、“有助于懲治腐敗、打擊各種嚴(yán)重犯罪”、“有助于更好地發(fā)揮公、檢、法的職能作用”、“有助于讓權(quán)力在陽光下運(yùn)行”、“有助于加快推進(jìn)全面依法治國的進(jìn)程”。通過論述,以期對當(dāng)前法制建設(shè)、法治實(shí)踐和推進(jìn)依法治國的進(jìn)程提供可資借鑒和積極指導(dǎo)。
[Abstract]:In the fourth Plenary Session of the 18th CPC Central Committee, the Party adopted the programmatic literature to comprehensively promote the rule of law and speed up the construction of a socialist country under the rule of law - "the Central Committee of the Communist Party of China's decision on the comprehensive promotion of several major issues of the rule of law." this is the first time that our party has made a comprehensive deployment on the subject of the rule of law for the first time in the history of the ruling. In the new era of the rule of law in China, general secretary Xi Jinping stressed that in the "four comprehensive" ideas of adhering to and developing the strategic layout of socialism with Chinese characteristics, it is necessary to "promote the rule of law in an all-round way". Peng Zhen, as the principal founder of the socialist legal system, has devoted his life to the construction of the legal system of new China, in legislation, law-abiding, law enforcement, judicature, power supervision. It has made outstanding contributions to the improvement of the socialist legal system, and has made great contributions to the improvement of the socialist legal system. Therefore, under the new historical conditions, it is very important to study Peng Zhen's legal ideology and draw its essence to guide the practice of the construction of the rule of law in China, and to solve some problems in the process of construction of the rule of law. The important practical guiding significance also has a positive reference value to the coordinated promotion of the "four comprehensive" strategic layout, the construction of a socialist harmonious society and the realization of the great rejuvenation of the Chinese nation. The full text is divided into four parts: the first part is the introduction. This part mainly discusses the reasons for the topic and the significance of the research. "The present situation of the research on Peng Zhen's legal ideology", "the research ideas and methods of this subject", "the expected goal, the innovation point and the shortcomings of the subject". Through the exposition, the background, purpose and significance of the topic are clarified, and the research status of Peng Zhen's legal thought is analyzed from two aspects of academic monographs and academic papers, and it is clear that the research status of the thought of the legal system is made clear. In the second part, the second part discusses the connotation of the thought of the legal system and the conditions for its formation. In this part, the connotation of Peng Zhen's legal thought is summed up, and the conditions for the formation of Peng Zhen's legal thought include objective conditions and subjective conditions. Conditions and theoretical conditions. Through further analysis, the subjective conditions of the formation of Peng Zhen's legal thought include: practical conditions and personal internal cause conditions, and the theoretical conditions for the formation of Peng Zhen's legal ideology include: "Peng Zhen's inheritance and development of Marx's and Lenin's legal thought", "Peng Zhen's criticism and succession to Chinese traditional legal thought." "Cheng" and "Peng Zhen's inheritance and development of the Chinese Communist Party's legal thought". The third part discusses the "formation process of Peng Zhen's legal thought and its main content". This part divides the process of the formation of Peng Zhen's legal thought into a producing stage, perfected stage and mature stage to explain, at the same time, the emphasis is on legislation, law abiding, law enforcement, and the Department. The main contents of the legal thought of the law, the power supervision and the democratization of democracy are analyzed and expounded. The fourth part discusses the contemporary value of Peng Zhen's legal thought. The part concretely analyzes the "theoretical value" and the "practical value" of Peng Zhen's legal thought. Through analysis, the author thinks that Peng Zhen's legal thought is considered. The theoretical value of the thought is: "promoting the Sinicization of the theory of Marx's doctrine of law" and "enriching and developing the theory of socialist legal construction". At the same time, combining with the concrete practice of the practice of the rule of law in China, the practical value of Peng Zhen's legal thought is as follows: "helping the whole socialist legal system", "helping to promote the legal system" "Ideas are deeply rooted in the hearts of the people", "helping to punish corruption and crack down on all kinds of serious crimes", "helps to better play the role of public, inspection and law", "helps to make power run in the sun" and "helps to speed up the process of the comprehensive rule of law".
