【摘要】:少數(shù)民族習(xí)慣法作為調(diào)整少數(shù)民族地區(qū)人們生產(chǎn)、生活的規(guī)范,對(duì)于少數(shù)民族地區(qū)糾紛的解決、秩序的穩(wěn)定發(fā)揮了重要的作用。長(zhǎng)期以來(lái),有很多學(xué)者對(duì)于少數(shù)民族習(xí)慣法和國(guó)家法的關(guān)系問(wèn)題進(jìn)行研究,但是大都集中于對(duì)二者的規(guī)定、內(nèi)容的分析,通過(guò)對(duì)內(nèi)容的比較來(lái)提出自己的見(jiàn)解。本文主要運(yùn)用法律經(jīng)濟(jì)學(xué)的一些基本思想對(duì)少數(shù)民族習(xí)慣法和國(guó)家法的關(guān)系問(wèn)題提出一些自己的理解。 本文第一章是對(duì)全文理論基礎(chǔ)的界定。在本章,著重介紹了科斯定理的貢獻(xiàn)與遺留的問(wèn)題,并提出了關(guān)于法律中心論與社會(huì)規(guī)范理論的界定。在此基礎(chǔ)上提出少數(shù)民族習(xí)慣法與國(guó)家法的關(guān)系問(wèn)題。 本文第二章是關(guān)于少數(shù)民族習(xí)慣法的基本介紹。在這一章,首先介紹了學(xué)術(shù)界對(duì)于習(xí)慣法的界定,然后對(duì)少數(shù)民族習(xí)慣法予以界定,將少數(shù)民族習(xí)慣法的特征概述為地域性、民族性、自發(fā)性和強(qiáng)制性。 本文第三章是對(duì)少數(shù)民族習(xí)慣法和國(guó)家法關(guān)系的分析。對(duì)于二者的關(guān)系,一般將其概括為相一致和相沖突兩方面。本章對(duì)于二者的一致性僅從表現(xiàn)和原因兩方面做簡(jiǎn)單的介紹。對(duì)于二者的沖突,則著力于在少數(shù)民族地區(qū)由于國(guó)家法和習(xí)慣法并存所產(chǎn)生的適用方面的沖突。在這一部分,主要運(yùn)用法律經(jīng)濟(jì)學(xué)的理性經(jīng)濟(jì)人假設(shè)和成本收益方法來(lái)分析少數(shù)民族地區(qū)更多選擇適用習(xí)慣法規(guī)范的原因。 本文第四章是對(duì)于少數(shù)民族習(xí)慣法和國(guó)家法關(guān)系的再審視。在本部分,主要從科斯的相互性思維、《無(wú)需法律的秩序》的啟示和實(shí)效主義法學(xué)的運(yùn)用這三方面來(lái)強(qiáng)調(diào)少數(shù)民族習(xí)慣法規(guī)范的重要性,并對(duì)于二者的沖突的調(diào)適提出自己的建議,以期達(dá)到法律的目標(biāo),實(shí)現(xiàn)社會(huì)的欲求。
[Abstract]:The customary law of ethnic minorities plays an important role in the settlement of disputes and the stability of order in minority areas as a norm to regulate the production and life of people in minority areas. For a long time, many scholars have studied the relationship between ethnic customary law and national law, but most of them focus on the provisions of the two, the content of analysis, through the comparison of the content to put forward their own views. This paper mainly uses some basic ideas of law and economics to put forward some understanding of the relationship between customary law and national law of ethnic minorities. The first chapter is the definition of the theoretical basis of the full text. In this chapter, the contribution and problems of Coase Theorem are introduced, and the definition of the theory of Law Center and Social norms is put forward. On this basis, the relationship between customary law and national law of ethnic minorities is raised. The second chapter is about the basic introduction of minority customary law. In this chapter, the author first introduces the definition of customary law in academic circles, then defines the customary law of ethnic minorities, and outlines the characteristics of customary law of ethnic minorities as regional, national, spontaneous and compulsory. The third chapter is the analysis of the relationship between ethnic customary law and national law. For the relationship between the two, it is generally summarized as consistency and conflict. In this chapter, the consistency of the two is simply introduced from the aspects of performance and reason. As for the conflict between the two, it focuses on the conflict in the application of national law and customary law in minority areas. In this part, the rational economic man hypothesis of law and economics and the cost-benefit method are mainly used to analyze the reasons why more customary laws and norms are applied in minority areas. The fourth chapter examines the relationship between customary law and national law. In this part, the author emphasizes the importance of the norms of minority customary law from three aspects: the mutual thinking of Coase, the enlightenment of "order without law" and the application of pragmatism. And put forward their own suggestions on the adjustment of the conflict, in order to achieve the goal of the law and realize the social desire.
