【摘要】：警察訊問不僅關(guān)系到每個犯罪嫌疑人的切身利益，更關(guān)系到一個國家社會的穩(wěn)定和法律的完善發(fā)展,作為機構(gòu)話語類型的警察訊問語言已引起研究者的關(guān)注和重視。本研究考察和分析了警察訊問筆錄中程式性話語的特點及其語用功能。語用學(xué)的語用預(yù)設(shè)，順應(yīng)理論和合作原則作為本文的主要研究視角，，旨在分析警察訊問筆錄中訊問人和被訊問人是如何運用語言功能來進行交際溝通的。 本文主要以浙江寧波地區(qū)刑偵大隊的訊問筆錄作為研究語料，分析、歸納和總結(jié)出訊問筆錄的六個突出特點，即程式性，公平性，不公平性，合法性，沖突性，目的性。進而采用語用學(xué)的相關(guān)理論，分析了訊問筆錄程式性話語中訊問人如何巧妙運用預(yù)設(shè)信息追問被訊問人最終得到事實真相，被訊問人如何躲避訊問人的追問；訊問人如何做到心理順應(yīng)和語境順應(yīng)而保證訊問順利進行；被訊問人遵循合作原則和違反合作原則的表現(xiàn)等內(nèi)容。 本研究認為，警察訊問筆錄有異于普通語言的特點，訊問人在訊問過程中應(yīng)該注意語言的使用和語言策略的運用，同時順應(yīng)被訊問人的心理和語境，最終達到不逼迫犯罪嫌疑人而是讓犯罪嫌疑人主動說出事實真相的目的。期望本研究能為進一步規(guī)范我國司法語言，確保司法公開，公平，公正提供一定的借鑒和啟示。
[Abstract]:Police interrogation is not only related to the vital interests of each criminal suspect, but also to the stability of a country and the perfect development of the law. As a kind of institutional discourse, police interrogation language has attracted the attention and attention of researchers. This study examines and analyzes the characteristics and pragmatic functions of programmed discourse in police interrogation notes. Pragmatic presupposition, adaptation theory and cooperative principle are the main perspectives of this thesis. The purpose of this study is to analyze how interrogators and interrogators use their language functions to communicate with each other in police interrogations. This article mainly takes the interrogation record of the criminal investigation team in Ningbo area of Zhejiang province as the research corpus, analyzes, summarizes and summarizes the six outstanding characteristics of the interrogation record, that is, program, fairness, unfairness, legitimacy, conflict and purpose. Then using the relevant theory of pragmatics, this paper analyzes how the interrogator skillfully uses the preset information to ask the interrogator to get the truth and how to avoid the interrogator. How to make the interrogator do psychological adaptation and contextual adaptation to ensure the smooth progress of interrogation, the interviewee follows the principle of cooperation and the performance of violation of the principle of cooperation, and so on. This study holds that the police interrogation record has the characteristics different from the common language. The interrogator should pay attention to the use of language and the use of language strategies, and adapt to the psychology and context of the interviewee. Finally, the aim of not forcing the suspect to tell the truth is reached. It is hoped that this study can provide some reference and enlightenment for further standardizing the judicial language and ensuring the judicial openness, fairness and justice.
