《淮南子》法律思想研究

【摘要】:法律究竟是什么?古今中外的許多學者都從不同方面闡述了自己的觀點。但即使如此,我們?nèi)圆荒軌驍嘌砸呀?jīng)通曉了法律的真諦。換言之,要想更全面、更深刻地理解法律,我們不能就法律而論法律,因為法律作為社會規(guī)范的一種,與其他社會規(guī)范緊密相連。也就是說,法律之外的諸多社會因素或許可以幫助我們更好地去探尋法律的本質(zhì)。文化無疑為我們研究法律提供了獨特的視角。由于法律是文化的重要組成部分,因此,任何一種法律都打上了一定文化的烙印,通過一定的文化,我們則能更好地去了解法律的形成、發(fā)展與變革。當下,我們正進行著“中國特色”的法治建設,自然不能脫離本民族文化這一“本土資源”,只有對其批判地繼承,才可能制定出適合中國國情的法律制度,這對構建社會主義和諧社會具有重要意義。 淮南王劉安及其門客所著的《淮南子》一書,在總結(jié)秦亡的歷史教訓的基礎上,對法家的思想進行批判和改造,同時又結(jié)合漢初的社會現(xiàn)實情況,以道家的清靜無為為旗幟,兼采各家的學術思想,從而使其法律思想在中國思想史上獨具特色。尤其是書中提出的“法籍禮義者,所以禁君,使無擅斷也”的法律觀對后世產(chǎn)生了深遠的影響。本文從法律文化學的角度,通過研究其法律思想產(chǎn)生的時代背景,分析其法律思想的主要內(nèi)容,以期客觀地評價其法律思想的價值,探尋其法律思想的現(xiàn)代意義。 論文分為五個部分。第一部分,概述淮南王劉安的生平,介紹《淮南子》一書的時代背景,分析《淮南子》一書的學派歸屬。第二部分,敘述《淮南子》法律思想產(chǎn)生的理論基礎,即黃老道家的“道”和“無為”。第三部分,詳細介紹《淮南子》一書的法律思想,包括“發(fā)于人間”生于“仁義”的法律起源論,“順勢因時”的立法觀,“精誠”、“無私”的執(zhí)法觀和“法籍禮義者,所以禁君,使無擅斷也”的法律觀。第四部分,對《淮南子》的法律思想做出評價,一方面總結(jié)其法律思想的進步之處,另一方面指出其法律思想的局限性,并從文化的角度探尋其原因。第五部分,論述《淮南子》法律思想的現(xiàn)代價值,通過找尋傳統(tǒng)法律思想與現(xiàn)代法治理念之間的契合之處,說明《淮南子》法律思想對我國進行法治建設的重要意義。
[Abstract]:What is the law? Many scholars from all over the world have expounded their views from different aspects. But even so, we cannot claim to know the true meaning of the law. In other words, if we want to understand the law more comprehensively and deeply, we can't deal with law in terms of law, because law as a kind of social norm is closely linked with other social norms. In other words, social factors beyond the law may help us to better understand the nature of the law. Culture undoubtedly provides us with a unique perspective for the study of law. Since law is an important part of culture, any kind of law is branded with a certain culture. Through a certain culture, we can better understand the formation, development and reform of law. At present, we are carrying out the construction of the rule of law with "Chinese characteristics". Naturally, we cannot break away from our own national culture as a "local resource". Only by critically inheriting it, can we formulate a legal system suitable to China's national conditions. This is of great significance to the construction of a harmonious socialist society. On the basis of summing up the historical lessons of the death of Qin Dynasty, the book "Huainan Zi", written by Liu An, the Huainan King, and his entourage, criticized and reformed the thought of the Legalists, and at the same time combined with the social reality of the early Han Dynasty, they took the quiet and inaction of the Taoists as the banner. At the same time, different academic thoughts are adopted to make their legal thoughts unique in the history of Chinese thought. Especially in the book, the legal concept of "legal courtesy and righteousness, so that the monarch is forbidden, so that there is no arbitrary," has had a profound impact on later generations. From the point of view of legal culturology, this paper analyzes the main contents of his legal thought by studying the background of its legal thought, in order to objectively evaluate the value of his legal thought and explore the modern significance of his legal thought. The paper is divided into five parts. The first part summarizes the life of Huainan King Liu An, introduces the historical background of Huainan Zi, and analyzes the school ownership of Huainan Zi. The second part narrates the theoretical basis of the legal thought of Huainan Zi, that is, the Taoism and inaction of Huanglao Taoism. The third part introduces the legal thought of Huainan Zi in detail, including the legal origin theory of "born in the world", the legislative view of "due to the times", the "sincerity", the "selfless" view of law enforcement and the "French courtesy". Therefore, the prohibition of monarch, so that there is no arbitrary view of the law. In the fourth part, the author evaluates the legal thought of Huainan Zi. On the one hand, it summarizes the progress of its legal thought, on the other hand, it points out the limitation of its legal thought, and probes into its reasons from the angle of culture. In the fifth part, the author discusses the modern value of the legal thought of "Huainan Zi", and explains the important significance of the legal thought of "Huainan Zi" to the construction of the rule of law in our country by looking for the coincidence between the traditional legal thought and the modern idea of ruling by law.
