【摘要】：法律在現(xiàn)今社會(huì)中起著十分重要的作用。它規(guī)定了人們的行為,調(diào)整了不同階級(jí)間的關(guān)系,并保障著公民的權(quán)利和國(guó)家的穩(wěn)定。因此,法律具有權(quán)力。而法律的權(quán)力是通過(guò)語(yǔ)言來(lái)體現(xiàn)的,顯然,法律語(yǔ)言也具有權(quán)力。然而,法律語(yǔ)言所具有的權(quán)力是隱含的。那么,法律語(yǔ)言是如何展現(xiàn)其權(quán)力的?語(yǔ)言與權(quán)力之間又有著怎樣的關(guān)系?本文將就這些問(wèn)題進(jìn)行討論。 批評(píng)性話語(yǔ)分析認(rèn)為整個(gè)世界是一種具有意識(shí)形態(tài)的社會(huì)結(jié)構(gòu),而批評(píng)性話語(yǔ)分析就致力于分析語(yǔ)言在應(yīng)用的過(guò)程中是如何反映這種意識(shí)形態(tài)的。因此,本文試圖從批評(píng)性話語(yǔ)分析的角度來(lái)分析法律語(yǔ)篇,從而揭示隱含在法律語(yǔ)言中的權(quán)力。 作者運(yùn)用費(fèi)爾克勞夫的三維理論框架和韓禮德的系統(tǒng)功能語(yǔ)法理論從宏觀和微觀兩個(gè)角度進(jìn)行分析。作者首先在韓禮德的系統(tǒng)功能語(yǔ)法的基礎(chǔ)上,對(duì)法律語(yǔ)篇的語(yǔ)言特征：詞匯、情態(tài)和及物性進(jìn)行了描述,并分析了在這一過(guò)程中權(quán)力意識(shí)是如何體現(xiàn)的。然后,作者又依據(jù)費(fèi)爾克拉夫的三維理論框架,綜合結(jié)合社會(huì)和歷史條件來(lái)闡釋法律語(yǔ)篇和社會(huì)結(jié)構(gòu)間的關(guān)系。具體地說(shuō),就是社會(huì)結(jié)構(gòu)是如何生成法律語(yǔ)篇,以及法律語(yǔ)篇對(duì)這些社會(huì)條件又會(huì)產(chǎn)生什么樣的影響。 作者認(rèn)為法律語(yǔ)篇作為調(diào)整社會(huì)關(guān)系和保障社會(huì)秩序的手段就必然體現(xiàn)一定的權(quán)力意識(shí)。因此立法者或其他法律人士在制定或運(yùn)用法律的時(shí)候,不僅要考慮到法律的權(quán)威性和強(qiáng)制性,還要兼顧被統(tǒng)治階級(jí)的可承受性。
[Abstract]:Law plays a very important role in today's society. It regulates the behavior of people, adjusts the relations between different classes, and guarantees the rights of citizens and the stability of the country. Therefore, the law has power. The power of law is embodied by language. Obviously, legal language also has power. However, the power of legal language is implicit. So how does the legal language manifest its power? What is the relationship between language and power? These problems will be discussed in this paper. Critical discourse analysis holds that the whole world is an ideological social structure, and critical discourse analysis is devoted to analyzing how language reflects this ideology in the process of its application. Therefore, this paper attempts to analyze the legal discourse from the perspective of critical discourse analysis, thus revealing the power implied in the legal language. The author makes an analysis from macro and micro perspectives by using the framework of Faircroft's three dimensional theory and Halliday's theory of systemic functional grammar. On the basis of Halliday's systematic functional grammar, the author first describes the linguistic features of legal discourse: vocabulary, modality and transitivity, and analyzes how the consciousness of power is embodied in the process. Then, according to Felke Ralph's three-dimensional theoretical framework, the author combines the social and historical conditions to explain the relationship between legal discourse and social structure. Specifically, how the social structure produces legal discourse, and what kind of influence legal discourse will have on these social conditions. The author holds that legal discourse, as a means of regulating social relations and ensuring social order, must embody a certain sense of power. Therefore, legislators or other legal personages should not only consider the authority and compulsion of the law, but also the affordability of the ruling class when making or applying the law.
