【摘要】：作為一項古老的法律制度,監(jiān)護(hù)在現(xiàn)代民法上著有非常獨特的功能與價值。它一方面起著保護(hù)被監(jiān)護(hù)人的基本權(quán)利的作用,另一方面又起著維護(hù)社會穩(wěn)定的作用,在保護(hù)行為能力欠缺者的合法權(quán)益方面有著不可替代的價值。伴隨著社會的進(jìn)步與人權(quán)意識的深入發(fā)展,監(jiān)護(hù)制度的功能和價值已逐步確立為以保護(hù)被監(jiān)護(hù)人的利益為核心。 本文主要介紹了我國與日本現(xiàn)行監(jiān)護(hù)制度的基本內(nèi)容,包括未成年人監(jiān)護(hù)制度與成年人監(jiān)護(hù)制度,并將我國的監(jiān)護(hù)制度與日本的監(jiān)護(hù)制度進(jìn)行了大概的比較,以期望從中發(fā)現(xiàn)我國監(jiān)護(hù)制度的不足之處,并借鑒日本較為先進(jìn)的監(jiān)護(hù)立法來完善我國的監(jiān)護(hù)制度。 本文分為四個部分,第一部分是:中日監(jiān)護(hù)制度體系的比較,分別介紹了我國和日本的監(jiān)護(hù)制度體系,并進(jìn)行了對比評析,提出了我國在制度體系方面的不足;第二部分是:我國與日本的未成年人監(jiān)護(hù)制度比較研究,主要闡述了我國及日本現(xiàn)行未成年人監(jiān)護(hù)制度的基本內(nèi)容,以及我國未成年人監(jiān)護(hù)制度在監(jiān)護(hù)類型、監(jiān)護(hù)與親權(quán)的關(guān)系、父母離婚后對監(jiān)護(hù)權(quán)的享有等問題上與日本未成年人監(jiān)護(hù)制度的差異;第三部分是:中日兩國成年監(jiān)護(hù)制度的比較研究,通過對中日兩國成年監(jiān)護(hù)制度在監(jiān)護(hù)理念、監(jiān)護(hù)類型、監(jiān)護(hù)人的選任、監(jiān)護(hù)人的監(jiān)護(hù)職責(zé)等方面的比較,分析我國在成年監(jiān)護(hù)制度方面的不足。第四部分是:日本監(jiān)護(hù)制度對我國以后的監(jiān)護(hù)立法有哪些啟示,并期望我國在今后的監(jiān)護(hù)立法中積極借鑒日本比較先進(jìn)的立法經(jīng)驗與立法理念,使我國的監(jiān)護(hù)制度更加完善。
[Abstract]:As an ancient legal system, guardianship has a very unique function and value in modern civil law. On the one hand, it plays the role of protecting the basic rights of the ward, on the other hand, it plays the role of maintaining social stability, and it has irreplaceable value in protecting the legitimate rights and interests of the incapacitated. With the progress of society and the further development of human rights consciousness, the function and value of guardianship system has been gradually established to protect the interests of the guardian as the core. This paper mainly introduces the basic contents of the current guardianship system between China and Japan, including the guardianship system of minors and adults, and makes a general comparison between the guardianship system of our country and the guardianship system of Japan. The author hopes to find out the deficiencies of the guardianship system in China, and use Japan's more advanced guardianship legislation for reference to perfect the guardianship system in our country. This paper is divided into four parts, the first part is: the comparison of the guardianship system between China and Japan, respectively, introduced the guardianship system of China and Japan, and made a comparative analysis, put forward the deficiencies in the system of our country; The second part is: our country and Japan minor guardianship system comparison research, mainly elaborated our country and the Japan present minor guardianship system basic content, as well as our country minor guardianship system in the guardianship type, The relationship between guardianship and parental power, the rights of custody of parents after divorce, and the differences between the guardianship system of minors in Japan and those in Japan. The third part is the comparative study of the adult guardianship system between China and Japan. Based on the comparison between Chinese and Japanese adult guardianship systems in terms of guardianship concepts, types of guardianship, selection of guardians, guardianship duties and so on, this paper analyzes the shortcomings of China's adult guardianship system. The fourth part is: what enlightenment does the Japanese guardianship system have to the future guardianship legislation of our country, and expect our country to draw lessons from Japan's more advanced legislative experience and legislative idea actively in the future guardianship legislation, make our country's guardianship system more perfect.
