【摘要】：法律與習(xí)慣既是法社會(huì)學(xué)的重要課題,也是法人類學(xué)的重要研究?jī)?nèi)容。20世紀(jì)美國(guó)法學(xué)家都在不同程度上論及法律與習(xí)慣,原因似乎在于,一方面,法律的內(nèi)部邏輯與外部證成之緊張關(guān)系不得不使法學(xué)家關(guān)注這一問(wèn)題;另一方面普通法的傳統(tǒng)似乎就是一種揭示法律內(nèi)部習(xí)慣的傾向。為此,霍貝爾、盧埃林、弗蘭克、卡多佐、埃里克森等都在不同角度、采用不同研究方法、或直接或間接地揭示了法律與習(xí)慣的關(guān)系。
[Abstract]:Law and custom are not only an important subject of sociology of law, but also an important research content of legal anthropology. In the 20th century, American jurists discussed law and custom to varying degrees, the reason seems to be that, on the one hand, The tense relationship between the internal logic of the law and the external evidence has to make jurists pay attention to this problem; on the other hand, the tradition of common law seems to be a tendency to reveal the internal custom of the law. Therefore, Hobell, Llewellyn, Frank, Cardoso, Eriksson and so on in different angles, using different research methods, or directly or indirectly revealed the relationship between law and custom.
