【摘要】：正中國法治理念和模式在同時吸收立法法治國、司法法治國和行政法治國的理念和制度的基礎(chǔ)上,構(gòu)建多元一體的政黨法治國,一種基于黨國互動體制的混合法治模式。在復(fù)興古典禮法互動的傳統(tǒng)上,重建政法傳統(tǒng)中的政治與法律、政黨與國家、黨法與國法的內(nèi)在互動,從而在歷史斷裂之中重新建構(gòu)起中華法治秩序的內(nèi)在連續(xù)性。就政黨法治國的建設(shè)而言,執(zhí)政黨最起碼要成為遵紀(jì)守法的先鋒模范,在依法治國中起到率先垂范的作用,要善于學(xué)習(xí)運用現(xiàn)代
[Abstract]:On the basis of absorbing the ideas and systems of the legislative law, the judicial law and the administrative law, the concept and mode of the rule of law in China is to construct a pluralistic political party and law system, a mixed mode of rule of law based on the interactive system of the party and the state. In the tradition of reviving the interaction of classical etiquette and law, reconstructing the internal interaction between politics and law in the tradition of politics and law, between the political party and the state, between the party law and the law of the state, and thus reconstructs the internal continuity of the order of ruling by law in China during the historical break. As far as the construction of political party and law is concerned, the ruling party should at least become the vanguard model of abiding by the law, play an exemplary role in governing the country according to law, and be good at learning and applying modern times.
