【摘要】：全球互聯(lián)網(wǎng)自20世紀(jì)90年代以來發(fā)展迅猛,極大地改變了人類的政治、經(jīng)濟(jì)和社會生活。互聯(lián)網(wǎng)不但對人類的生活有著重要影響,而且成為法治建設(shè)的助推器:一方面,互聯(lián)網(wǎng)在人權(quán)保障方面發(fā)揮著重要作用;另一方面,互聯(lián)網(wǎng)促進(jìn)了傳統(tǒng)監(jiān)督模式和民主模式的轉(zhuǎn)型,有效地制約了公權(quán)力的膨脹和濫用。然而,不容忽視的是,互聯(lián)網(wǎng)的發(fā)展也給現(xiàn)代社會帶來了新的人權(quán)危機和民主危機。除此之外,網(wǎng)絡(luò)世界的自由和秩序問題時常發(fā)生沖突,如何處理好這一問題,直接關(guān)涉法治建設(shè)的程度。只有完善互聯(lián)網(wǎng)人權(quán)保障體系,建立政府與人民之間的溝通機制,加強網(wǎng)絡(luò)立法,規(guī)范網(wǎng)絡(luò)秩序,才能使上述問題得到有效解決。
[Abstract]:The global Internet has been developing rapidly since the 1990s, which has greatly changed the political, economic and social life of human beings. The Internet not only has an important impact on human life, but also serves as a booster for the building of the rule of law: on the one hand, the Internet plays an important role in guaranteeing human rights; on the other hand, Internet promotes the transformation of traditional supervision mode and democratic mode, and effectively restricts the expansion and abuse of public power. However, it can not be ignored that the development of the Internet has also brought a new crisis of human rights and democracy to modern society. In addition, the freedom and order of the network world often conflict, how to deal with this problem, directly related to the degree of the construction of the rule of law. Only by perfecting the Internet human rights guarantee system, establishing the communication mechanism between the government and the people, strengthening the network legislation and standardizing the network order, can the above problems be solved effectively.
