【摘要】：女性犯罪是指女性主體嚴重地侵犯了個人法益、社會法益或者國家法益,且沒有排除違法犯罪的事由,理應受到刑事處罰的行為。傳統(tǒng)上,女性犯罪案件的數(shù)量并不多,女性的犯罪率遠遠小于男性。近些年來,女性犯罪率逐年上升,增長率甚至超過男性,這是極其不正常的。女性犯罪現(xiàn)象已經(jīng)成為不容忽視的社會問題,制約著國家經(jīng)濟、政治、文化等各方面的發(fā)展與進步。女性的犯罪年齡結(jié)構(gòu)呈現(xiàn)多樣化,青少年女性犯罪率逐年上升。女性的犯罪種類更廣泛,不限于傳統(tǒng)的女性犯罪類型,職務犯罪開始增多,女性犯罪團伙開始出現(xiàn),緊跟時代的步伐,還出現(xiàn)了大量的新型犯罪,如隨著網(wǎng)絡的普及,出現(xiàn)的網(wǎng)絡性犯罪、女大學生裸貸引發(fā)的犯罪,在面臨生育壓力的情況下,出現(xiàn)的代孕黑鏈條等。女性犯罪的原因是多方面的,有個人的原因,包括心理原因和生理因素;也有社會的原因,包括政治、經(jīng)濟、文化、婚姻家庭等多重因素。女性犯罪表現(xiàn)出多種形態(tài),有基于反抗而實施的犯罪,有基于生計而實施的犯罪,有基于貪婪而實施的犯罪等。女性是維系家庭和社會的重要紐帶,若女性走上違法犯罪的道路,會造成嚴重的影響,女性犯罪為其自身的發(fā)展帶來不利的后果,女性犯罪給家庭造成致命的打擊,女性犯罪阻礙社會前進的步伐。當今中國的政治、經(jīng)濟、文化、社會發(fā)展極度不平衡,面對復雜多變的社會環(huán)境,女性不能很好的適應社會為其帶來的角色轉(zhuǎn)換,社會變革在女性身上產(chǎn)生排斥反應。預防女性犯罪,需要全社會的共同參與。女性要努力提高自身的素質(zhì),接受正規(guī)的教育和加強道德建設。社會應該為女性提供一個更加公平的生存環(huán)境,合理配置資源,增加女性平等參與社會的機會;加強法治社會的建設,形成良好的社會風氣,引導女性樹立正確地價值觀。國家應該制定出臺相應的法律、法規(guī)、政策,有效地保護女性的利益以防止女性因制度的不完善,通過自力救濟構(gòu)成犯罪。另一方面,國家應該針對女性犯罪的特殊性制定相應的處罰措施,如針對輕微的女性犯罪實行暫緩起訴制度,將“受虐婦女綜合癥”作為法定量刑情節(jié),對女性犯罪引入保安處分制度,廢除女性犯罪的死刑制度,對女性犯罪人實行社區(qū)矯正制度等。
[Abstract]:Female crime refers to the behavior that the female subject seriously infringes the personal legal interest, the social legal interest or the national legal interest, and does not exclude the cause of the illegal crime, and should be punished by the criminal law. Traditionally, the number of crimes committed by women is small, and the crime rate of women is far lower than that of men. In recent years, the female crime rate rises year by year, the growth rate even exceeds the male, this is extremely unusual. The phenomenon of female crime has become a social problem that can not be ignored, restricting the development and progress of national economy, politics, culture and so on. The age structure of female crime is diversified, and the juvenile female crime rate increases year by year. The types of female crimes are more extensive, not limited to the traditional types of female crimes, the crimes committed by women begin to increase, the female criminal groups begin to appear, keep up with the times, and a large number of new types of crimes have emerged, such as with the popularity of the Internet. The network crimes, the crimes caused by female college students' naked loans, the surrogacy black chain and so on in the face of fertility pressure. There are many reasons for female crime, including personal reasons, including psychological reasons and physiological factors, and social reasons, including political, economic, cultural, marriage and family factors. There are many forms of female crime, such as crime based on resistance, crime based on livelihood, crime based on greed and so on. Women are an important link to maintain the family and society. If women take the road of illegal crime, it will cause serious impact, female crime will bring adverse consequences for their own development, and female crime will deal a fatal blow to the family. Female crime hinders the progress of society. Nowadays, the political, economic, cultural and social development of China is extremely unbalanced. In the face of the complex and changeable social environment, women can not adapt to the role transformation brought by the society. The prevention of female crime requires the participation of the whole society. Women should strive to improve their own quality, accept formal education and strengthen moral construction. Society should provide a more equitable living environment for women, allocate resources rationally, increase the opportunities for women to participate in society equally, strengthen the construction of a society ruled by law, form a good social atmosphere, and guide women to set up correct values. The state should formulate relevant laws, regulations and policies to protect the interests of women effectively to prevent them from becoming a crime through self-relief because of the imperfections of the system. On the other hand, the state should formulate corresponding punishment measures according to the particularity of female crime, such as suspending prosecution system for minor female crime, taking "battered woman syndrome" as the legal circumstances of sentencing. Introduce security measure system to female crime, abolish the death penalty system of female crime, and carry out community correction system for female offender.
