【摘要】：2015年《立法法》修改賦予了所有設(shè)區(qū)的市立法權(quán),適應(yīng)了全面推進(jìn)依法治國(guó)和推進(jìn)地方治理法治化的需求。但賦予所有設(shè)區(qū)的市立法權(quán),也使得設(shè)區(qū)的市面臨著立法能力不足、破壞社會(huì)主義法制統(tǒng)一、地方保護(hù)主義法律化、立法規(guī)定不明等風(fēng)險(xiǎn)。因而,我們必須要通過加強(qiáng)設(shè)區(qū)的市立法能力建設(shè)、健全設(shè)區(qū)的市立法權(quán)的監(jiān)督制度、加強(qiáng)立法中的公眾參與、健全相關(guān)立法等途徑,對(duì)其進(jìn)行防控,以實(shí)現(xiàn)設(shè)區(qū)的市立法權(quán)擴(kuò)容的目的。
[Abstract]:The 2015 revision of the Legislative Law gives all municipalities legislative power to be divided into districts and meets the needs of comprehensively promoting the rule of law and promoting the rule of law in local governance. However, the legislative power given to all the cities divided into districts also makes them face the risks of insufficient legislative capacity, undermining the unity of the socialist legal system, legalizing local protectionism, and unclear legislative provisions. Therefore, we must prevent and control it by strengthening the legislative capacity building of the municipalities divided into districts, improving the supervision system of the legislative power of the municipalities divided into districts, strengthening the public participation in legislation, and perfecting the relevant legislation, etc. In order to achieve the expansion of district legislative power.
