【摘要】：1958年,美國《聯(lián)邦航空法》確立航空承運(yùn)人在航空運(yùn)輸活動中不得違背非歧視原則。美國最高法院區(qū)分"航班超售本體"和"實(shí)施航班超售行為"分別認(rèn)定是否違背非歧視原則。規(guī)制國際航空運(yùn)輸領(lǐng)域的航班超售,美國適用內(nèi)外一致的監(jiān)管標(biāo)準(zhǔn),對本國和外國的航空承運(yùn)人適用相同法規(guī)。征詢自愿被拒載的志愿者應(yīng)當(dāng)同時(shí)面向全部旅客,切忌特別或者先后征詢。適用優(yōu)先登機(jī)規(guī)則的前提是征詢志愿者人數(shù)不足。優(yōu)先登機(jī)規(guī)則含括"先訂先得""先到先得"和"復(fù)合參考權(quán)衡"3個(gè)規(guī)則。航班超售非歧視原則促進(jìn)航空運(yùn)輸發(fā)展并可作為旅客維權(quán)的替代路徑。中國修訂《民用航空法》可借鑒美國作法的有益經(jīng)驗(yàn)。
[Abstract]:In 1958, the Federal Aviation Act of the United States established that air carriers should not violate the principle of non-discrimination in air transport activities. The Supreme Court of the United States distinguishes between "overselling of flights" and "carrying out overselling of flights", respectively, whether it violates the principle of non-discrimination. To regulate the oversale of flights in the field of international air transport, the United States applies the same regulatory standards both internally and externally, and applies the same laws and regulations to domestic and foreign air carriers. Volunteers who have volunteered to be rejected shall be open to all passengers at the same time and should not be consulted specially or successively. The prerequisite for applying the priority boarding rule is that the number of volunteers consulted is insufficient. Priority check-in rules include first-order, first-served, first-come-first-served and composite reference tradeoffs. The non-discrimination principle of flight overselling promotes the development of air transport and can be used as an alternative way for passengers to protect their rights. China's revision of the Civil Aviation Law may draw on the useful experience of the United States.
