【摘要】：地方行政立法是我國(guó)立法體制的重要組成部分,公眾參與地方行政立法是保證行政立法合法化、科學(xué)化的有效手段,是地方行政民主化的重要體現(xiàn)�，F(xiàn)代行政立法要求公眾廣泛參與到立法過(guò)程中。近年來(lái),全國(guó)各地廣泛開(kāi)展了公眾參與行政立法的實(shí)踐活動(dòng)。座談會(huì)、聽(tīng)證會(huì)、公開(kāi)征求意見(jiàn)等形式的公眾參與已經(jīng)成為我國(guó)地方行政立法中的一道風(fēng)景。但公眾參與地方行政立法在制度上還很不完善,在實(shí)踐中仍處于分散的、個(gè)案的階段。目前研究地方行政立法中的公眾參與具有非常重要的理論和現(xiàn)實(shí)意義。 本文分為六個(gè)部分,第一部分是引言,指出了論文的研究背景和意義、國(guó)內(nèi)外研究現(xiàn)狀,明確了論文研究的理論工具和方法,并分析了論文寫(xiě)作的難點(diǎn)、創(chuàng)新點(diǎn)和不足。第二部分闡述了公眾參與地方行政立法的理論基礎(chǔ)與價(jià)值。在對(duì)公眾參與、行政立法、公眾參與行政立法等概念做出解釋的基礎(chǔ)上闡述了公眾參與地方行政立法的理論基礎(chǔ)和價(jià)值意義。理論基礎(chǔ)包括人民主權(quán)論、參與式民主理論、正當(dāng)法律程序原則、行政法學(xué)中的控權(quán)論。價(jià)值意義包括推進(jìn)依法治國(guó)基本方略、提高政治民主化程度、保障公共利益和公眾利益、防止行政自由裁量權(quán)的濫用、保證地方行政立法的科學(xué)性與科學(xué)性等方面。第三部分介紹了公眾參與地方行政立法的制度現(xiàn)狀,主要是對(duì)《立法法》、《規(guī)章制定程序條例》、《廣州市規(guī)章制定公眾參與辦法》中的有關(guān)公眾參與的法條規(guī)范進(jìn)行了梳理和分析。第四部分對(duì)公眾參與地方行政立法的實(shí)踐狀況進(jìn)行了案例分析。剖析了北京市《酒仙橋危改工作補(bǔ)充意見(jiàn)》、《廣州市亞洲運(yùn)動(dòng)會(huì)知識(shí)產(chǎn)權(quán)保護(hù)規(guī)定(草案)》的公眾參與情況。第五部分對(duì)影響公眾參與地方行政立法的因素進(jìn)行了分析。簡(jiǎn)要介紹了有利因素,著重分析了不利因素。不利因素包括社會(huì)方面的不利因素、制度方面的不利因素、地方政府自身方面的不利因素、公眾方面的不利因素和信息互動(dòng)方面的不利因素。第六部分提出了推進(jìn)公眾參與地方行政立法的基本思路。通過(guò)對(duì)影響參與因素的分析提出了完善我國(guó)公眾參與地方行政立法的對(duì)策路徑。包括地方政府需要樹(shù)立全新的行政立法觀念、完善公眾參與地方行政立法相關(guān)制度、提高公眾參與意識(shí)和參與能力、拓寬公眾參與的方式和渠道等方面。完善公眾參與地方行政立法,并非朝夕之事,還需要很長(zhǎng)的路要走。希望本文的研究對(duì)保障公眾的立法參與權(quán),促進(jìn)地方行政立法民主化有益。
[Abstract]:Local administrative legislation is an important part of our legislative system. Public participation in local administrative legislation is an effective means to ensure the legalization and scientization of administrative legislation and an important embodiment of the democratization of local administration. Modern administrative legislation requires extensive public participation in the legislative process. In recent years, the practice of public participation in administrative legislation has been widely carried out all over the country. Public participation in the form of forums, hearings and public opinions has become a scenic spot in our local administrative legislation. But the system of public participation in local administrative legislation is not perfect, and in practice, it is still in the stage of dispersed and individual cases. At present, the study of public participation in local administrative legislation has very important theoretical and practical significance. This paper is divided into six parts, the first part is the introduction, pointing out the research background and significance of the paper, the current research situation at home and abroad, clear the theoretical tools and methods of the paper research, and analyzes the difficulties, innovations and shortcomings of the paper writing. The second part expounds the theoretical basis and value of public participation in local administrative legislation. On the basis of explaining the concepts of public participation, administrative legislation and public participation in administrative legislation, this paper expounds the theoretical basis and value significance of public participation in local administrative legislation. The theoretical basis includes the theory of people's sovereignty, the theory of participatory democracy, the principle of due process of law, and the theory of control in administrative jurisprudence. The significance of value includes promoting the basic strategy of governing the country according to law, improving the degree of political democratization, safeguarding the public interest and public interest, preventing the abuse of administrative discretion, and ensuring the scientific and scientific nature of local administrative legislation. The third part introduces the current situation of public participation in local administrative legislation, mainly combing and analyzing the relevant regulations of public participation in "legislation Law", "rules of procedure" and "measures of Public participation in rules and regulations of Guangzhou City". The fourth part analyzes the practice of public participation in local administrative legislation. This paper analyzes the public participation in the "complementary opinions on the crisis and Reform of Jiuxianqiao" in Beijing and the regulations on intellectual property Protection (draft) of the Guangzhou Asian Games. The fifth part analyzes the factors that affect the public participation in local administrative legislation. The favorable factors are briefly introduced, and the disadvantageous factors are emphatically analyzed. The disadvantages include social factors, institutional factors, local governments themselves, the public and information interaction. The sixth part puts forward the basic idea of promoting public participation in local administrative legislation. Based on the analysis of the factors affecting the participation, this paper puts forward the countermeasures to perfect the public participation in the local administrative legislation. Including local governments need to establish a new concept of administrative legislation, improve the public participation in local administrative legislation related systems, improve public participation awareness and ability, and broaden the way and channels of public participation. Improving public participation in the local administration and legislation is not an overnight thing, it still has a long way to go. I hope this study is beneficial to the protection of the public's right to participate in legislation and to promote the democratization of local administrative legislation.
