【摘要】：清末修律中法理派人權(quán)思想在中國近現(xiàn)代人權(quán)思想發(fā)展史上占有非常重要的歷史地位。法理派人權(quán)思想不僅體現(xiàn)了中國傳統(tǒng)人道主義向近代人權(quán)主義的轉(zhuǎn)變,而且開啟了中國近代人權(quán)保護(hù)進(jìn)入法制領(lǐng)域的大門,同時也為中國資產(chǎn)階級人權(quán)理論的形成發(fā)展奠定了基礎(chǔ),體現(xiàn)了時代進(jìn)步性。從法理派人權(quán)思想的當(dāng)代價值來看,不僅對當(dāng)代中國人權(quán)事業(yè)發(fā)展與進(jìn)步具有現(xiàn)實指導(dǎo)意義,而且對當(dāng)代中國人權(quán)保護(hù)法制化建設(shè)具有借鑒意義,同時也對當(dāng)代中國國家治理體系和治理能力現(xiàn)代化具有啟迪意義。
[Abstract]:In the late Qing Dynasty, the human rights thought of the Legalist School occupies a very important historical position in the history of the development of Chinese modern human rights thought. The human rights ideology of the Legalist School not only embodies the transformation of Chinese traditional humanitarianism to modern human rights doctrine, but also opens the door for the protection of human rights in modern China to enter the field of legal system. At the same time, it lays a foundation for the formation and development of Chinese bourgeois theory of human rights and embodies the progressive nature of the times. From the view of the contemporary value of the legal school's human rights thought, it has practical guiding significance not only for the development and progress of human rights cause in contemporary China, but also for reference to the legal construction of human rights protection in contemporary China. At the same time, it also has enlightening significance to the modernization of governance system and governance ability of contemporary China.
