【摘要】：除了脫離歐盟,英國還在蓄謀另一場脫歐:廢除1998年《人權法案》,甚至脫離《歐洲人權公約》。后者除了源于反恐和維護議會主權等現(xiàn)實考量,也跟英國"反人權"的三種思想傳統(tǒng)有關。其中,普通法強調(diào)權利源于習慣而成于司法救濟,保守主義強調(diào)權利保護要守先待后、寓新于舊,功利主義強調(diào)權利內(nèi)容取決于權衡利弊,三者共同反對"人權"說唯邏輯、認死理的特點,體現(xiàn)了務實內(nèi)斂、妥協(xié)調(diào)和的"英國性"。
[Abstract]:In addition to leaving the EU, Britain is planning another Brexit: repeal of the 1998 Bill of Rights, or even of the European Convention on Human Rights. In addition to practical considerations such as anti-terrorism and parliamentary sovereignty, the latter is also related to Britain's three anti-human rights traditions. Among them, the common law emphasizes that the right originates from custom and becomes judicial remedy, the conservatism emphasizes that the protection of the right should wait before the old, the utilitarianism emphasizes that the content of the right depends on weighing the advantages and disadvantages, and the three oppose the logic of the theory of "human rights". Recognition of the characteristics of reason, reflects the pragmatic and introverted, compromise and reconciliation of the "British."
