【摘要】：較大的市立法權(quán),是伴隨著我國改革開放發(fā)展起來的,在中國特色社會主義法律體系中,具有不可忽視的地位。它是我國一元兩級立法體制中的一個有機組成部分,數(shù)量龐大且很活躍,這對于推進較大的市依法行政、管理地方事務(wù)已經(jīng)和正在發(fā)揮著重要作用。對較大的市立法進行審查批準(zhǔn),是省級人大常委會的一項重要職權(quán),是維護社會主義法制統(tǒng)一的保障。較大的市立法審查批準(zhǔn)機制,在實踐中開展得富有成效,但又存在一些亟待解決的問題,因此有必要對此制度進行研究,并提出相應(yīng)的建議和措施。 本文主要包括五部分：第一部分主要對我國現(xiàn)行立法體制進行概說,介紹我國立法體制的類型,較大的市的范圍、相關(guān)概念界定等；第二部分,論述了我國較大的市立法發(fā)展所經(jīng)歷的三個階段及立法審查批準(zhǔn)機制的現(xiàn)狀；第三部分是對較大的市立法審查批準(zhǔn)機制的必要性分析,從維護社會主義法制的統(tǒng)一和憲法尊嚴、防止地方保護主義、保障地方立法的科學(xué)性等方面,說明審查批準(zhǔn)制度存在的必要性；第四部分,介紹了學(xué)界對這種制度存在的幾種不同觀點；第五部分,對目前這種審查批準(zhǔn)制度存在問題進行分析,并從完善法律制度和工作機制兩個方面提出了完善較大的市立法審查批準(zhǔn)制度的建議和措施。
[Abstract]:With the development of China ' s reform and opening - up , the large city legislative power has an important role in the socialist legal system with Chinese characteristics . It is an integral part of the two - level legislative system in China . It is an important function of the Standing Committee of the provincial People ' s Congress . It is an important function of the Standing Committee of the Provincial People ' s Congress .

This paper mainly includes five parts : the first part mainly introduces the current legislation system of our country , introduces the type of our country ' s legislative system , the scope of the larger city , the definition of the relevant concept , etc .
The second part discusses the three stages of the development of city legislation in China and the status quo of legislative review and approval mechanism .
The third part is the necessity analysis of the approval mechanism of the large city legislation review , from the aspects of maintaining the unity of the socialist legal system and the constitutional dignity , preventing the local protectionism and guaranteeing the scientific nature of the local legislation , etc . , and explains the necessity of examining the existence of the approval system ;
The fourth part introduces several different opinions about the existence of the system in the academic circle ;
The fifth part analyzes the existing problems of the current review and approval system , and puts forward some suggestions and measures to improve the approval system of municipal legislative review from aspects of perfecting the legal system and working mechanism .
